Levy Wants Possession F. Levy ys T. Aufrance is the title of a new suit filed in Department .o. 2 of the state cirruit eourt for Marion coun ty. The j action was brought by Mr. Levy to gain possession of 290 acres of land located in townships 7 and 8 south, range 1 west, of which he claims to be the owner, and the possession of which he alleges the defendant has wrongfully withheld from him sinee October 1, 1904. In addition to hb re quest for n decreee granting him po' scspion of; the premises, Mr. Levy asks that he be awarded general damages in the sura of $5iH), and 'special damages to the amount 0f $750. Jearman, who has tbe contract for painting the roof on the city hall building, passed through an unpleasant experience yesterday and narrowly es caped instant death. ' At about 3 o'elwck in the afternoon, Mr. Jearman, suspended by a rope, was painting on the side of the tower with nothing be tween himself and the cement walk be low but 100 feet of space. The shock so unnerved Mr. Jearman that he was unable to proceed with his work during the rest of the afternoon. Unusual Accident Edward Burns, who lives three miles west of the steel bridge in Polk county, had the unusual experience for this psrt of the state, this week, of having the flesh stripped from the bones of the thumb of the left band, it having Iwen caught under the roe around the horn of a saddle while Mr. Burns was roping a voung calf. Dr. K. E. Slater ampu tated the denuded bones and dressed the painful injury. Paid Last Week It was stated in a 'personal item in the Statesman of yesterday that Charles Grissen. president of the Ore gon Fire Relief Association, of Me Minnvillv, was in Salem 'on Wednesday attending to tbe S-hindlor loss. This was a mistake. Mr. Grissen was in town, but merely pay iag a social and general business call. The Scbindler loss was settled by II. A- Johnson, the company's Marion ronnty ' aeent, last week. Number of Decisions Handed Down, the First in Several Weeks One Marlon County Case (From Wednesday's Daily.) The Supreme Court rendered the fol lowing decisions yesterday afternoon: : In the case of Porter Slate, respon dent, vs.. J. E. Henkle, as administra tor of the estate of Frances Slate, de ceased, appealed from Linn county, the decision of Judge -Boise was reversed. This is the case where Frances Slate of Benton county died intestate on No vember 22, 1895. The county court of Linn county appointed Slate as admin istrator. Some time after, the county court of Benton county appointed Henkle, who sued Slate for recovering certain money that had been expended on the estate account, and fees with held. Thv case of the State of Oregon, respondent, vs. Frankie Wooldridge, apdlant, appealed from Multnomah countv, in which Wooldridge appealed for judgment on conviction of the crime of perjury in case of John Rob erts vs. Oregonian Publishing Company for SlO.fMHK damages. The attorney claimed that the information on; which Fraukie Woolridjje was tried does not state sufficient facts to constitute a crime. The court held that the crime of perjury, if perpetrated, 'was fully consummated when the defendant gave the alleged false testimony.
