low and Emma M. Kellow, duly is­
sued by the County Clerk of Polk
County, Oregon, on the 31st day of
January. 1922. and to me. the un­
dersigned Sheriff, directed, for the
enforcement of a judgment and de­
cree given and made by the Circuit
Court of the State of Oregon for
said County of Polk in a certain
suit in said court wherein Dallas
City Bank, a corporation,
was
plaintiff, and M. C. Kellow. Emma
M. Kellow, Ed. W. Mueller, alias Ed.
W. Miller. Geo. L. Carlile, Howard
Campbell, Earl J. Campbell and
John Doe, were defendents. Regia-
ter No. 5480. in favor of said plain-

requires the payment of money, and
on which there is now actually due
the sum of $1,262.33, with Interest
thereon at the rate of seven per
cent per annum since June 24, 1921,

cannot be found, then out of the

exceed fifty thousand dollars ($50.-
000), said bonds to be in denomin-
ations of five hundred dollars
($500) or one thousand dollars
($1,000) each, duly signed by the
Mayor and countersigned by the Re­
corder, whereby Tillamook City
shall be held in substance and effect
to undertake and promise to pay the
bearer of each of said bonds at ma­
turity thereof the sum named there­
in in gold coin of the United States
of the present standard of value
with interest thereon in like gold
coin at the rate of six P"" cent (0
percent) per annum payable semi­
annually, each of said bonds to be a
direct general obligation of Tilla­
mook City, Oregon, said bonds to be
dated at a convenient time to be af­
fixed by the Council, maturity or
maturities to be likewise fixed by
the Council, but not to exceed
twenty (20) years from i date; the
principal and intercat of said bonda
to be made payable at the Fiscal
Agency of the State of Oregon in
New York City, which said bonds
shall be known as “Tillamook City
Funding Bonds”, which bonds shall
be sold by the Council as In Its
judgment may be best.
2. The proceeds derived from
the sale of the said bonds shall be
paid to the City Treasurer, and the
surplus, if any, over and above the
amount necessary to redeem the
aforementioned warrants with in-
ter eat shall be paid into the gen­
eral fund; provided however, that
in the event that the amount real­
ized from the sale of the said bonds
shall be insufficient to redeem said
warrants, the general fund shall be
drawn on to make up such deficit.
3. It shall be the duty of the
City Treasurer to see to the proper
application of the funds derived
from the sale of said bonds .and the
purchaser or purchasers thereof
shall in no event be responsible or
charged with the proper application
of the funds derived from the sale
thereof.
4. The debt limitations contain­
ed In the charter of said City shall
not apply to the bonds hereby auth­
orized.
5. The Council shall each year
at the time of making the annual
tax levy for city purposes, inti

interest on the outstanding bonda
