Congressman Hawlev ia Coming. rons and the cheese maker of Red Clover Congressman W. C. Hawley will be in Tillamook next Saturday and Sunday, and his visit to the county will be in the interest of harbor improvements and to become acquainted with the members of the Port of Tillamook Commission, for it is the congressman's desire to work in conjunction with the Port and do every thing possible for the improvement of (Joquarton slough and the bar. The business men of this city are arranging for a banquet in honor of the congress man's visit and on Sunday it it has lieen decided that the business men take Mr. Hawley down the bay in the Frolic, which haslieen chartered for the occa sion. The launch will leave the dock about nine o'clock, and tickets to the banquet will entitle persons, with tbeir wives, to enjoy the trip with the con gressman to the bay on the Frolic. TILLAMOOK CHEESE WINS Red Clover Creamery Co. Awarded First and Second Prices at the State Fair. Sept. 17, 1909 Red Clover Creamery, Tillamook, Ore Red Clover wins first prize on cheese. Score 95. A. H. Supreme Court Interposes on Behalf of Hembree. S alem , Or.. Sept. 21.—The Supreme Court today handed down an (opinion, written by Chief Justice Moore, reversing the case of the state vs. A. J. Hembree) This is the notorious Tillamook County murder case, In which the de fendant, llembree, was accused of kill ing his wife and daughter and then burning the bodies to destroy the gvi- dence of the crime. Hembree, it will be remembered, was first convicted of manslaughter for killing ¿his daughter. After serving one year of an Indeter, minate sentence, Hembree was par oled by Governor Chamberlain. Re turning to Yamhill County he was rearrested, charged with murdering bis wife, and upon the trial of ths case at Dallas, io Polk County, Judge Burnett presiding, the defendant was found guilty of muider in the first degree and sentenced to be hanged. In hie opinion Chief Justice Moore holds that " proof of the commission of other offenses having no connection with the crime for which a defendant is on trial, is irrelevant and inadmis sible. " The principal ground on which the case is reversed was the error of the ' lower court in admitting the testimony ' of M. H.
