The contract for the construction of the final 53 miles of the Pacific Railway & Navigation Company was let Mon day. J. W. Sweeney, Isaac Blumauer and S. N. Binmauer were the successful bid ders. It is understood that the Harri man engineers' estimate of <2,000,000 was scaled about $500,000. It has been understood for a consider able time that Sweeney and his financial backers were the lowest bidders, the one obstacle to clinching the contract being the delivery of a bond for $100,000. The usual bond would be 10 per cent on the total or $150,000, but it is generally be lieved that President E. E Lytle, of the Pacific Railway A Navigation Company strained a point in this respect to give the benefit to a local contractor. Mr. Sweeney was unable to obtain his bond up to .Monday, but he was able to fiurmsh proofs that the bond would be forthcoming before the final date given him by Mr. Lytle, and with this under standing he was informed he might con sider the contract his, but was not per mitted to sign up until he could definitely produce his bond. The bonding com pany is said to have been annoyed bv the efforts of the other contractors who have tried to prove Mr. Sweeney inca pable of carrying out the'contract. It is understood that the amount of Mr. Sweeney’s bid approximated very closely $1,500,000, although no confii- malion could be had from Mr. Lvtle. Caughern & Woldson, of Spokane, who hnya handled some of the C. M. &. St. P. work, were the next lowest contract ors, being about $30,000 above Sweeney in their bid. A. J. .McKabe was third bidder, and was still $30,000 to the bad. Mr. Sweeney was a sub contractor on Southern Pacific extension from Drnin to Coos Bay, and when further construe lion was stopped he withdrew. The contract is ono of the largest let in the state of Oregon, and is certainly the largest contract let in Oregon for some years. By commencing immediate construction it is thought the whole line may be completed by the summer of 1910, and probably in time to take care of a portion of the beach traffic in that season. Many difficulties confront the con tractor. lie must construct wagon roads where ro v but rough trails exist. This will call for an expenditure of prob ably $200,000, and this must be done before the contractor is reimbursed a cent. The distant is 58 miles There are 19 tunnels of varying length, and in many places the roaring mountain tor rents must be bridged. Much of the con struction er braces rock work excep tionally heavy in chnracter. lulius Kruttschnitt announced to Pres ident Lytle over a month ago that the funds were at the disposal of Mr. Lytle for the building of what will become a subsidiary Harriman line. Mr. Lytle has earned some little distinction as a railroad builder, having been the builder of the Columbia Southern to Shaniko and the Condoo road toCewtral Oregon. He also made the Harriman survey up the Deschutes Canyon. The case of Andy Nolan vs. the First National Bank was up for trial before Judge Galloway. Attor ney Nolan caused a great deal of sur- Diise when he asked Mr. Walton when he and Gus Kunz entered into an agree ment to steal this money from Nola n and Stewart. Attorney Holmes objected to any such question being put to the wieness and appealed to the court. Attorney Nolan withdrew thequeatii-n aud said he would put it in a different way, nnd instead ol doing so, he askec Mr. Walton when he and Gns Kunze en tered into a conspiracy to defraud Nolan and Stewart. Imlge Galloway became indignant une su< h that the attorney should methods in conducting his case, ai.d forthwith Nblan had to apologize to t le court and to the witness, after which t le judge admonished the attorneys who had been insulting the court and witness es,nnd he was going to take measurt-n t«> stop it. He said it was a. disgrace to Tillamook, and on that account the Tillamook Bar had n bad reputation. On his circuit he said that Tills moo I was tbe’onlv place where the attorney« insulted the court and the witnesses.. because of their good work, next Sunday evening in the way of giving them a chance toanswerabout ninety hard ques tions on the Bible.
