It has always been the custom, so far as we have ever heard, for the sheriff, in giv*ng notice of execution sales, to pub lish the same in any paper which the at- tornev for plaintiff should request. In pursuance of this custom, as attorneys tor Peter Brant, having directed the clerk to issue an execution upon a judgment and decree in Mr. Brant’s favor in the Circuit Court, we, at the time of giving instructions as to the levy to tie made, requested Deputy Sheriff Coates to have notice of sale published in the Headlight. No objection was made to this request. Afterward, without anything being said to us about the matter, the notice was handed to another paper for publication. When we learned of this we objected very strongly and called Mr. Woolfe’s attention to the custom which had pre viously been followed without exception. Upon learning of this custom Mr. Woolle agreed to follow it and to withdraw the notice if it could be conveniently done, but finding that it had, by that time» been set up in type, it was agreed that it should be allowed to run, but that in the future the request of the attorneys interested should govern. In doing this we were standing for the privilege which had been granted and exercised by the attorneys of Tillamook County for years. We thought, and still think, that this was proper and right : that as the plaintiff in the case is responsible for the expense incurred in this matter, that he, or his attorneys who represent him in the case, should l>c alloAcd to say where the expense should lie incurred, and that he should not lie compelled to patronize persons ob jectionable to him or his attorneys, and neither the sheriff nor any other person should be allowed to assume the role of dictator in a matter of that kin<1( but that the custom of years, which has proven satisfactory, should lie continued as we are pleased to know, it is to lie. P.8.—Since writing the foregoing we have been informed by Mr. Woolfe that he will not I k * able to stand to his agree ment as to allowing attorneys to desig nate the paper in which notices of sale are to be published ; that Ins friends and supporters will not allow him to have i I such notices published in either the Headlight or the Herald ; that, while he desires good feeling and harmony with the attorneys, still he cannot resist the demands ol his supijorters in the matter. If if was possible for them to do so, the people of this county would have grappled with the problem, as they did with the dairying industry, but it is too big a cud for them, considering they had as much as they could handle and finance clearing up land for more pasture.
