The proposition for a railway coun has leceived attention from those who are giving consideration to the railway problem and it has some supporters among those who have been giving the most earnest attention to that question. Senator Elkins among others has ex pressed the opinion that a railway court is the only practicable way out of existing difficulties, that such court will ulti mately have to be established in order to meet the questions involved in the prob lem of regulating the railroads by the government. This is the view taken by the leading members of the Interstate Commerce commission. In his testimony before the house committee on interstate a nd foreign commerce last week Coni« miseit ner Prauty took a decided position in favor of a railway court—not a trib unal, as he indicated, to supersede the Interstate Commerce commission, but to co-operate with it by taking charge of all those cases which are appealed from its decision ami with which it is now so dif ficult to induce ordinary courts to deal. The idea of such a court, it is pointed out.is by no means a new one. There is precedent for it in England and elsewhere and while the conditions are not pre cisely the same abroad as here, yet to all intents and purposes the circumstances are such as to justify the application of similar principles in this country as are operative abroad. At any rate the pro position for a railway court, which would have final jurisdiction and authority in regard to questions arising under the authority and rulings of the Interstate Commerce commission, is one that is en titled to the mofct careful consideration, particularly in view of the fact that it lias the support of members of the Inter state Commerce commission and senators who are advocating legislation for strengthening the powers of the com mission.
