A regular meeting of the Town Coun cil wits held on Monday evening all be ing present. A communication was received from Mayor Colin and read, appointing tlie various committees for the present year as provided by ordinance. The com mittees are as follows: On Ways and Menns, Knudson ; Reynolds, Goodspeed, Ordinances, Reynolds; Thoinjisoii, Hadley, Accounts and Current Expenses, Goodspeed, Thompson; Reynolds. Streets and Public Property, Goodapeed, Thompson; Reynolds, Licenses, Knudson ; Goodspeed, Thompson, Fireand Water, Hedley; Reynolds, Knudson, Health and Police, Goodspeed, Thompson, Hadley; Printing, Reynolds Goodspeed ; Hadley, The question uf the improvement ot certain streets was taken up at this time. Abe Cohn was preser.t and advo cated tlie improvement of Main street, and others called attention to certain other streets. Tlie matter was referred to tlie Sheet Committee to report at next regular meeting Mr. Orchard, of tlie Waterworks Company, was present, and offered to furnish water tree for a hydrant to lie pul in near the school building, provid ed the City would bear tlie expense oi the hydrant. On motion tlie Recorder was instructed to order another hydrant for tlie place. City Attorney May submitted hia re port with reference to tlie controversy tietweed the city authorities and Coun ty Authorities relative to double taxation of proj>erty within tlie City limits. Mr. May stated that lie had appeared before the County Court, and made to it a prop , oeition as ordered by the Council at its last meeting. Tlie proposition made to the County Court was as follows: "Tillamook Ore. Mayßth 1807, To Tillamook County, Oregon, and the Hon. Judge, and Cuuimisioiiera thereof; Gentlemen; The City of Tillamook by its Attorney W. J. May, duly authorized, begs leave to submit tlie following proposition to wit: That whereas, during Ilia month of January 1897 the County Court of Mid county levied a tax upon the persons and property of said city, and Mid city likewise leved a tax upon Mid persons and property, and siuco Mid taxes 00 levied are in conflict in certain particn- lare, and in case Ilia eaid persona aud property ownerwjesiding or owning prop vrty is Mid city pay ell of said taxes so levied they will iu certain particulars be paying double taxes, not authorized by law ; mid whereas said city at its said January meeting at which suid levy was made did levy the following taxes upon* the persons and property within said city to wit: two mills general tax, two mills road tux ami two dollars pvoll tax (road poll) aud said County Court nt its said January meeting did levy upon tlie said persons and property a five mill road tax and it two dollat road poll tax ; Now, therefore, said city would most respectfully ask said lion. Court to in struct the sheiitl and tax collecter of said county te collect and turn over Io said city the nniount of taxes so levied by it as aforesaid and not to collect from the lesidenls of saiil city liny other road poll tax, mid further instruct said sheriff to collect from the taxable property of said city enough additional road tax over mid above that levied by laid city to make 6 mills road tax which addition al sum lie shall likewise collect for mid tm ii over to said T illamook City.” Respectfully Submitted, Tillamook City, by W. The county co urt it seems expressed a willingness to let tbe city have the 5 mill road tux if it bo insisted, to expend the whole inside tbe city limits, but Judge Conder atateil Hint lie did not think it the best policy for the city so to do as some of the 6 mills should be ex pended oil the roads lending into town, especially that leading west. The county court at its last meeting had taken the matter under advisement and made the following order: "In the matter of n double levy of certain taxes within the incorpoi ata limits of the City of Tillamook It ap pearing to the satisfaction of the court that there is a double levy of taxes made in the said city to the amount of 2 mills on the property mid $2 00 poll tax for roml purposes. It is hereby ordered Hint the shei iff do not collect two mills on all the property ivitlilnthe limits of said Tillamook City so leved for roml purposes, mid not to collect |2.00 poll tax so levied for road purposes within said incorporate limits of Baid city, ami that at the filial settle ment with saiil sheriff he shall be credit ed with said taxes ordered not collects I.' This order of the county court was understood by the council to be a tacit refusal to grant the eitv the entire 5 mills mid a determination to collect the said 5 mills ami use it ns the court saw best, ami on motion of uouiicilman Rey Holds seconded by councilman Hadley a resolution was passed that injunction proceedings be commenced ami the coun ty enjoined from collecting any tuxes ill excess of the legal levy The following bills were presented mid ordered paid: 1210.08 Woolfe 4 Zwicker hydrant! .60 0.
