Page 4 The INDEPENDENT, May 5, 2011 Kay declined chance to give up police certification, sending case to full board From page 1 Following their investigation, in a March 15 letter, DPSST gave Kay two choices: give up his certification to be a police officer or, if not, the case goes to the DPSST Police Policy Committee to review the inves- tigation and make a recommen- dation whether to revoke his certifications based on his con- duct. The letter listed 10 items in three areas: 1) that he misrepresented, to the Court, whether two individu- als had completed community service and when this was in- vestigated he was untruthful with the investigators (this is- sue was initiated by the Ver- nonia Justice Court), 2) that Kay was untruthful with the city and the DPSST in- vestigator about his member- ship with the Oregon Police Ca- nine Association (OPCA), and retroactively sought, obtained and submitted 15 K9 certifica- tions that he knew did not meet standards. In this category are seven items Kay is said to have misrepresented, concluding that on March 1 he signed a K9 Lease Agreement in which he represented that he and the K9 were currently certified to stan- dards equivalent to OPCA when he knew, or should have known that was not so (this is- sue was raised in October 2010 after an investigation by The In- dependent of the K9 program), 3) In 2004, during his pre- employment interview, Kay was dishonest by omission and mis- representation in explaining his having been the subject of a re- straining order (this issue was also initiated by The Indepen- dent after their investigation in October 2009 found legal docu- ments referring to Kay’s arrest and trial on a domestic restrain- ing order violation), After the April 14 deadline for Kay to voluntarily relinquish his certification, DPSST sent a let- ter on April 26, saying they had found five more questions on the original pre-employment application that, “it appears you did not truthfully answer…” That letter concluded saying Kay’s case will be heard before the DPSST Police Policy Com- mittee on May 19. The recom- mendation of the Police Policy Committee then goes to the full board, which may either affirm or overturn the recommenda- tion. In a letter dated May 3, 2011, interim Vernonia Police Chief Michael Conner gave notice that he was resigning from that position and return- ing to his former position as police sergeant, as is allowed in his employment agree- ment. He cited “ recent circum- stances out of my control, and recent decision made by City Council” as circum- stances triggering his deci- sion, adding “It appears that the support for the Police De- partment from some City Council is only for one mem- ber of the department.” Conner’s resignation as chief was effective May 4, 2011. ODFW will provide equip- ment including rods, reels and bait. Angling education instruc- tors and volunteers will be pres- ent to answer questions and of- fer assistance to less experi- enced youth anglers. “This is an excellent opportu- nity for kids to discover fishing,” said Ron Rehn, STEP biologist for ODFW’s North Coast Water- shed. “We’ll have plenty of ex- perienced staff and anglers at the event to answer any ques- tions and provide instruction.” Under Oregon Sport Fishing Regulations, anglers ages 13 and under can fish for free while those 14-17 will need to have a juvenile angling license. All fishing regulations continue to apply during this event.
