SMITH AND JOE HORSLEY, constituting the Board of Director of Horsefly Irrigation District. for judicial examination and Judgment of the above named Court as to the regularity and legality of the proceedings of the Board of Directors of said district in adopting a resolu tion authorizing and directing the issuance and sale of bonds of said district in the sum of $32,500.00 and providing for the terms and maturities there of, for the purpose of refund ing present outstanding in debtedness of said district, and for the further purpose of a judicial examination and judg ment of said Court as to the regularity and legility of the proceedings of said board in authorizing the execution, for and on behalf of said district of a contract with Reconstruc tion Finance Corporation, for the sale to said corporation and the purchase by it of all or part of the aforesaid bonds and a judicial examination and judgment of said Court as to the legality of such bonds and said contract as aforesaid; and further, for a judicial ex amination and judgment of said Court as to the right and duty of said irrigation district to levy each year, until said bonds have been paid in full, the necessary assessments pro vided for by said bond resolu tion and contract for the pur pose of paying the principal and interest of said bonds. To Horsefly Irrigation Dis trict of Klamath County, Ore gon, and to all freeholders, legal voters and assessment payers within said district: IN THE NAME OF THE STATE OF OREGON: You are hereby notified that Benson Dixon, Jerome E. Smith and Joe Horsley, constituting the Board of Directors of Horse fly Irrigation District, a muni cipal corporation and irrigation district within Klamath County, Oregon, have filed in the above entitled Court a special proceed ing for the purpose of having a judicial examination and Judg ment of said Court declaring and decreeing that Horsefly Irriga tion District is an irrigation dis trict duly organized, acting and existing under and by virtue of the laws of the State of Oregon. That at all of the times and dates mentioned in said petition, the said petitioners, and each thereof, was and now it a duly elected, qualified and acting di rector of said district and con stituted and do now constitute the Board of Directors of said district; that at all of said times and dates Benson Dixon was and is the duly appointed, quali fied and acting President of said district, and that at all of said times and dates Dorothy J. Eyers was and is the duly appointed, qualified and acting Secretary of said district. That the resolution of the Re construction Finance Corpora tion dated May 24, 1940 and the resolution of the Board of Di rectors of Horsefly Irrigation District dated September 3rd, 1940 constitute a lawful con tract between said Reconstruc tion Finance Corporation and said Horsefly Irrigation District and is a lawful contract on the part of said Horsefly Irrigation District, and that all matters and things connected therewith and all proceedings of said Board of Directors and said dis trict with relation thereto have been duly and regularly held and had in the manner and as pro vided by law, and that the ex ecution of said contract on the part of said district has been regularly and duly authorized. That all of the proceedings of the Board of Directors of said district authorizing and direct ing the issuance of refunding bonds of said district in the amount of $32,500.00 for the purpose of refunding present outstanding Indebtedness of said district in the form and as set forth in the resolution Exhibit "D" to said petition and said contract set forth in Exhibit "A" and "B" to said petition and all matters and things connected therewith and all of the pro ceedings of the Board of Direct ors of said district with relation thereto have been duly and regu larly held and had in the manner and as provided by law, and said bonds with said maturities and in the form and tenor therein set forth are regularly and legal ly authorized, and when execut ed and issued by said district and delivered to said Recon struction Finance Corporation as provided in said contract as so modified as aforesaid, will be the legal and valid obligation of Horsefly Irrigation District without any advertisement or public sale thereof. That pursuant to said contract as aforesaid and said resolution, the said Horsefly Irrigation Dis trict is possessed of the right and is in duty bound to levy each year the assessments there in provided for, for the purpose of paying principal and interest upon said bonds; that said right andduty continues until said NEWS AND THE HERALD. bonds and all accrued Interest thereon have been paid in full, and that said contract and said bonds when issued and nego tiated as aforesaid shall consti tute valid and enforceable obli gations of said district, and further, all freeholders, legal voters and assessment payers within said district and all parties in interest and said dis trict and all parties in interest and said district Itself be for ever barred and concluded from disputing, contesting or question ing the validity or legality of any of the foregoing proceed' ings or of said bonds and con tract and any assessments here after levied pursuant thereto, and that the petitioner have a decree for such further relief as may seem equitable to the Court. This notice is served upon you pursuant to an order of Hon. David R. Vandenberg, Judge of the above-entitled Court, made April 10th, 1941, by publication of this notice once each week for three suc cessive weeks in The Evening Herald, a newspaper of general circulation published in Klamath County. Oregon, the last of said publications to be made on the 25th day of April, 1941, and the Jurisdiction of the above named Court in the above matter will be complete ten days after the completion of publication. Any person interested may at any time before the expiration of said ten days appear and contest the validity of such proceedings or of any act or things therein enumerated. You are further notified that the hearing of said petition by said Court has been set for the 20th day of May, 1941 at the hour of 10:00 a. m. at the Court room of the above named Court at the Court House in the City of Klamath Falls, Klamath County, Oregon.
