The rase was set for hearinK March 15th. The club woman's prison sentence was delayed pending the ruling on this motion which followed the su preme court's action in dismissing her first appeal from the convlc- tlon." Xo Specific Ruling ' ' The court's first action did not rule specifically on the constitution ality of the California law, which makes mere memberRhlp in an or ganization devoted to overthrow of tho existing government through violence, a felony. In her appeal. Miss Whitney argued that a federal question of constitutionality was in volved, demanding a court ruling on the law.
