SANITY TESTS PLANNED Robert Beaty Fennell, 29," a former patient at the Iowa Mental institution, and an Air Force veterans, will undergo mental tests after he was ar rested in Berkeley, Calif., this week on a vagrancy charge. At the time of his arrest, he was carrying a note threat ening President Johnson. UPI Telephoto. Oregon Delegation Split Over Dunes Park Plan WASHINGTON UPI ' - Rep. Robert B. Duncan. D-Ore., said today that differences among members of the state's congres sional delegation over the pro posed Oregon Dunes National Seashore were not "irreconcil able." "I don't look for any split in the delegations." he said. "Peo ple of good will can disagree over an issue without engaging in personalities." Duncan, in whose district the proposed national seashore would be established, told Uni ted Press International he was "encouraged" by the progress on the park. The Oregon Democrat's com ments contrasted sharply with comments made earlier by Sen. Wayne Morse. D-Ore.. in a bit ing attack on the Senate In terior Committee. Blames Committee Morse accused the commit tee of having "split the Oregon delegation" by reporting out a hill which would prr.vicie fur the condemnation of private prop erty for the proposed seashore. "The committee will have to assume the responsibility 'or a hitter political controversy that will rage for. some time in Ore gon." Morse told the Senate Thursday night. "I do not like to see our dele gation involve itself in a Demo cratic civil war in my state." Morse said. ' But that is what we are headed for. It ought to be avoided " Duncan said he had not had a chance to read Morse s speech and so could not comment on it. In his Senate attack on the Oregon .Dunes bill, Morse re peated his earlier contention that it was "not necessary to condemn one square foot" of private property for the park. The national seashore, Morse said, could be created entirely from stale and federal lands. Sen. Alan Bible. D-Nev., chair man of the subcommittee which hammered out the hill, ex pressed the hope that something satisfactory to Alor.se could be worked out. , "'understand there might be some discussion of the project at a later date in January or February." Bible said Legislation to create the park was introduced in the House by Duncan and in the Senate by Sen. Maurine B. Neuberger, D Ore. As appYoved by the Senate Interior Committee, it would provide for a 30,000-aero park. The provision for condemna tion of private property was im mediately attacked by Morse and by four Republican mem bers of the committee. On the condemnation issue, Duncan said it necessarily, fol lowed once a decision w as made to have recreational develop ment for public use. "I don't see how you can avoid having the ultimate power of condemnation." he said. UPI Telephoto Of Threatening Note The suspect. Robert Beaty Fennell, 29. of Sioux City, Iowa, was ordered committed for psy chiatric examination Friday fol lowing an appearance before U. S. Commissioner Cameron Wolfe. Bail was set at $5,000 and the case was continued to Jan. 3. "Dist. Judfje Oliver J. Carter signed the commitment order on the request of U. S. Attor ney Cecil Poole. Fennell is charged with "wilfully and knowingly threatening to do bodily harm to or threatening the life of President Lyndon Johnson." Fennell spent four months in an Iowa state mental institu tion in 19S9 after he was arrest ed for allegedly threatening the life of a girl friend. Doctors classified him as a schizophren ic and declared him cured when they released him. Fermc'.l's written threat against the President was dis covered after he was picked up Thursday night in Berkeley for vagrancy. When Fennell was booked Thursday night he gave his oc cupation as "unemployed social psychiatrist." Police said they had seen him loitering in Berkeley for some time and decided to ar rest him for vagrancy. When he was taken to the po lice station he had food and a note in his pocket. "Unless Americans accept their political responsibility and abolish the office i underlined i Man Gets Baboon Kidney DENVER (UPI 1 A 40-year-old patient at Colorado General Hospital had hopes today of be coming the second man in med ical history to survive the trans, plant of an animal's kidneys to his body. The unusual operation was performed Friday and the man, who was not identified, was re ported in "satisfactory" condi tion today. The kidneys of a baboon were inserted in his body to replace his ow n diseased kidneys. The operation came three days after announcement at New Or leans of the successful trans plant of a chimpanzee's kidneys to a man. That operation was performed Nov. 5 but not re vealed until Tuesday. Doctors at Charity Hospital in New Orleans said their patient had recovered sufficiently In go home for Christmas. Ruby Bail Hearing i Tomorrow DALLAS (UPI) Colorful, painstaking preparations were underway today for Monday's bail bond hearing for Jack Ru by, executioner of President Kennedy's accused assassin. Attorney Melvin Belli flew in from San Francisco Friday and started a weekend huddle w ith his five . lawyer defense staff, psychiatrists and the murder suspect. During a talk with reporters he waved a hook entitled "Psy chiatry and the Law." Dist. Atty. Henry Wade prom ised to doggedly oppose hail freedom for Ruby. Belli wore a four - collared coat, cowboys boots and sun glasses, despite a heavy over cast of clouds upon his arrival. He said a battery of psychia trists had been lined up for Ruby's Feb. 3 trial, where the defense will plea the night club operator was temporarily insane when he fired a shot into Lee Harvey Oswald. A lie detector (polygraph) test on Ruby was planned by the defense. Belli said.
