The district has acquired prop erty for oxidation equipment north of Weed Golf Club. The state Board of Health re cently recommended that the dis trict improve the old equipment, Yreka Woman Faces Charge ' YREKA Sheriff deputies this week arrested Beth Devene Mur phy, 43, en a warrant issued from justice court cnarging ner wiui felony dninlt driving. The charge was lodged after an auto accident Jan. 3 near here in which Mr. and Mm. Ernest Lis- Kwski and their three children, Ronald. Paul and Diane, all of Salem, were injured. '- Mrs. Murphy was booked at Siskiyou County Jail here and re leased on payment of (1,000 bail. She is scheduled to appear in Yreka Justice Court Jan. 17 at 10 a.m. for arraignment. Liszewskt and the three chil dren were released from Siskiyou County General Hospital here Fri day. Mrs. Liszewski was confined for further treatment at the hos pital. To Swear In Minecr Jan. 27 SALEM (AP) - Gov. Mark 0. Hatfield said Tuesday that Dr. Leon P. Minear. principal of Port land's Benson Tech High School, will be sworn in as the new super Intended of public instruction at 9:30 a.m. Jan. 17. Minear was appointed by the governor to succeed Dr. Rex Put- Bam, who resigned the post Water Flows On Spilhvay YREKA According to Yreka City Councilman Charles Coolcy, water beean flowing over the Spillway at Greenhorn Dam Fri day. Ho slated the water has been just a few inches of the top of the dam for the past two weeks. Water has been pumped from Greenhorn Reservoir consistently for city use and to keep the pipes from freezing. Coolcy also stated that other city wells and reservoirs are be. ginning to fill. He added that mi problems exist with leakage in the dam, and holes in the bottom of the Greenhorn Reservoir seem well sealed. Court Reverses Ruling On Tax SALEM (API The Oregon Su preme court today reversed a Marion County circuit court ruling that had declared void certain special assessments for street and sidewalk improvements. v The opinion was written by Jus lice Gordon Sloan, but Justice George Rossman wrote a dissent ing opinion and was joined by Chief Justice William M. McAl lister. The majority said at no time during the proceedings had any objections ever been filed until after the assessment ordinance was approved by the City Council borne ot - the property owners made application to pay in install ments and others paid, a few un der protest. The trial court of Judge Val D. M. Kim sey was commended today by Police Chief Lee Clark for two acts of public service that may have resulted in lives saved. Recently during his early morn ing patrol, Kimsey noted a car from Washington parked near Mac's Market in north Dunsmuir, The motor was ninning and the driver appeared to be asleep. Kimsey had to turn on his po lice siren to arouse the occupant of the locked car. Henri an Heston of Seattle explained to Kimsey that he had become drousy while driving and had left the motor and heater of the car on when he pulled off the highway to rest Apparently there was a carbon monoxide leakage because Hes ton had to be walked around for about an hour before he was ful ly awake and Kimsey took him to a nearby restaurant for cof fee before Heston resumed his journey to San Francisco. In the second instance, Kimsey broke the lock of a restroom door in a downtown restaurant to give aid to a choking woman. He was called from the street by a waitress. ' t 4 r m MRS. Corrcia, Yreka attorney, was denied a motion for a retrial in the matter of Lokey versus Pine Mountain Lum ber Company lawsuit last Friday by Judge Richard B. Eaton, pre siding in Siskiyou County Superior Court here. Correia maintained In a hearing Friday afternoon that the jury was guilty of misconduct, that contributary negligence on the part of Dean Lokey, plaintiff, had been established and that instruc tions to the jury were not adequate. All three charges were ruled against by Judge Eaton. Lokey was represented by the Messner, Hurley and Biglcr law firm. Pine Mountain Lumber Company was represented by the Tebbe and Correia firm. The jury awarded Lokey $67, 288 damages, believed to be the largest amount ever granted from the Siskiyou County Super, ior Court in such a suit. WEED-College of the Siskiyou; Governing Board members wil hear results of a sample ballot Polio Reduced To Record Low NEW YORK (AP)-The Nation al Foundation said today the in cidence of infantile paralysis was at an all-time low in the United States last year. There were 1.3 polio cases per 100,000 Americans last year, the foundation said, compared with an attack rate et 4.9 cases per 100,- 000 in 1959. The rate in the peak epidemic year of 1952 was 37.2 per 100,000. The foundation said provisional figures of the U.S. Public Health Service show a steep over-all de cline in the incidence of polio in the six years that the Salk polio vaccine has been available. College Board Will Hear Results Of balloting Mayor Takes Tax Stand DUNSMUIR Mayor Dave Mc- Clfntock's firm stand on the city- versus-county sales tax situation brought a heated retort from W. A. Barr, Second District supervisor. In a letter addressed to the city council, Barr accused McClintock of failing to avail the city of the opportunity of having its sales tax collected by the state. He wrote "if more money is needed land it will be) for the ever- upward swing of government, the supervisors can and no doubt will simply add a little to your adval- nrfm tax." State statistics indicated that Dunsmuir collected 80.2 per cent of the sales tax that it could have collected had tax collections been made by the state. State administered collections are onlv possiDie wnen a saies tax is on a county-wide basis, At present, enactment of county-wide sales tax hinges on agreements of city-county per centages within the incorporated cities. Dunsmuir, with other cities which passed sales tax ordinances before the county considered the measure, is holding out for a 80- 10 per cent split. The county would like at least a 15 per cent cut. Mayor McClintock denied that he is trying to spend money that is not collectable.
