Rifkind issued tyrfinal report Tuesday on a plan tyni the half-century dispute ov?r: the water of the lower basin of the Colorado River. Rifkind, appointed by the U.S. Supreme Court to hear the case, called for pro-rating use of the water to future dry years between the states of Arizona, California and Nevada. - The decision was a victory for Arizona, which had lost four pre vious suits filed against California in an attempt to win more water. It abandoned the West's tradition al "first come, first served" wa tc -priority rule. It also reflected an agreement between Arizona and New Mexico as to their dispute over the water in the Gila River system. The report said agreement had been reached on apportionment of the waters of a portion of the Gila river system among Arizona and New Mexico. It postponed adjudi cation of rights in waters of the tributaries of the Colorado in the Lower Basin on the ground that 'these streams are still under- appropriated and that the contro versy with respect to them has hot become real and genuine." Water for Indians In allocating water to Indian reservations, the report said each Indian reservation on the main stream is given a priority in spe cific amounts of water as of the date the reservation was created This allocation Is to be treated as part of the apportionment of the state in which the Indian lands are located. In periods of short supply, the report said, all three states on the mainstream of the Colorado Ari zona. California and Nevada are treated on a parity. "No one state has a priority to available supply as against any of the other states, except that if there is not enough water to satis. fy perfected rights that existed in 1929,. these must . first . be sat isfied," the report said. Rifkind said the final report has been mailed to all parties and the Supreme Court. The parties may file exceptions to all or any part of it, and the Supreme Court may consider the matter of these excep tions. The water case has been In and out of the courts for half a cen tury. In 1935, the controversy gen- crated such heat that Arizona called out its National Guard for a period of six. months.. It went to the high court for the first time in 19S2. TU 1-1471 Attorney General Says Service Plan Is Illegal SALEM AP)-Atty. Gen. Rob' ert Y. Thornton Wednesday said the dental service plan offered by Denial Services, Inc., constitutes an unauthorized practice of den tistry by a corporation. Thornton Issued the opinion at the request of the Oregon State Board of Dentistry. The corporation's plan would allow it to keep 75 per cent of the membership fees under con tracts with beneficiary members and distribute 25 per cent to participating dentists, he said. The attorney general said tnat the. dentists in turn would give beneficiary members a 50 per cent reduction on dental bills. Thornton said a corporation can not engage in the practice of don tistry for profit by employing the services of dentists.
