Granted Man
SAN FRANCISCO (AP) - The
right to appeal to the U.S. Court
of Appeals was granted Tuesday
lo a man serving a life sentence
for murder in the Oregon State
Prison.
Dupree Poe, a native of China,
contended irregularities existed
in his 1932 Marion County Circuit
Court trial. His recent petition for
a writ of habeas corpus was re
jected by the U.S. District Court
in Oregon.
His constitutional right of due
process and equal protection un
der the law were denied, he con
tended, when the trial court, aft
er his conviction, refused to pro
vide a means for him to appeal
to the Oregon Supreme Court.
Appellate Judge Walter L. Pope
said in granting Poe's appeal
right said "The district court de
nied the petitioner's application
without a hearing. Had he been
given an opportunity to be heard,
it is possible he might have made
a case for relief."

Plant Mulled

SAX FRANCISCO (VP1) - The
Dow Chemical Company has an
nounced plans to build a chemi
cal plant with a capacity to an
nually produce some 36 million
pounds of phenol.
The plant will be built some
where in the Pacific Northwest,
according to R. L. Curtis, vice
president, and Leland A. Doan,
general manager of Dow's western
division.
The possible sites are near Pu-
get Sound, Washinington, Long
view, Washington, or Portland,
Oregon. Several million dollars
will be spent on property develop
ment and plant construction before
operations begin early in 1961.
