Burton is retiring next Monday alter 13 years on the Su preme Court opening the way for the court's first Eisenhower-appointed majority. The White House announced the 70-year-old jurist's unexpected re quest for retirement Monday night a short time after the court opened its regular fall term. The announcement gave no indi cation of whom President Eisen hower might name as a successor to Burton or how soon he might act. Burton, a Republican, wrote Ei eenhower he was retiring "with regret but In accordance with competent medical advice and with a desire to serve the best interests of all concerned." Bur ton's two-paragraph letter didn't elaborate. Approving the request, Eisen hower praised Burton for "devoted and dedicated public service." "Our country is indebted to you." Eisenhower wrote. Eisenhower's appointment of a successor will be his fifth to the nine-man court. Broadcaster Misses Slide . LA GRANDE (AP) An earth slide rumbled down onto Highway SO west of here Monday alternoon, narrowly missing two automo biles. William Winter, American Broadcasting Co. news commen tator, was in one of the threaten ed cars. He said it looked as though "half of a mountain" slid down onto the road about 200 yards in front of him. He and a motorist in front of him managed to stop. The highway was blocked about 45 minutes until highway crews working nearby managed to open a lane. The incident delayed Winter's fcheduled speaking engagement before the Eastern Oregon Edu cation Conference here. Most of (he 1.200 delegates waited for the delayed talk. Except for his selection of Chief Justice Warren a former Califor nia governor and twice an aspirant for the Republican presi dential nomination Eisenhower has picked Supreme Court judges from other judicial posts. Of the three other Eisenhower appointees. Justices John M. Har lan and Charles Evans Whittaker were federal appeals court judges and Justice William J. Brennan was a member of the New Jersey State Supreme Court. With Burton leaving, the court has five Democratic and three Re publican members, the latter be ing Warren, Harlan and Whit taker. Burton's retirement leaves the court with only one justice, Tom C. Clark, who was appointed by former President Truman. The other three were named by Frank lin D. Roosevelt. They are Jus tices Hugo L. Black, Felix Frank furter and William 0. Douglas. Burton, at the time a Republi can senator from Ohio, was named by Truman to the high bench Oct. 1. 11)45, when Justice Owen J. Roberts, also a Republi can, retired. Burton described his political position at the time as the center, between left and right. "I hold to the belief that if folks get around a table and talk things through they usually can come to the right and fair answer," he said. Discussing his years on the court, Burton told a news confer ence at Brunswick, Maine, two weeks ago that the school integra tion issue was one of two high marks during his court service. The other, he said, "was the attempt of President Truman to lake over the steel mills in .1932." Burton was with the six-justice majority that ruled against Tru man in the steel case. He also joined in all the court's unani mous school segregation decisions since the original ruling in 1954. When Truman named him to the bench. Aides Have No Authority While Pope Pius XII Ailing VATICAN CITY (UPI) No official of the Roman Catholic Church can temporarily exercise the lull authority of Pope Pius XII while the Pontiff lies in capacitated at his villa in nearby Lastel bandollo. Missing was a coin collection, jewelry and appliances which hepple valued at $1,655. But decisions which are within the province of a pope alone must be delayed pending his recovery or, in event of his death, the election of a successor. Such powers cannot be dele gated to tjn.vone no matter how long the Pope might remain in capacitated. Vatican sources said there is no known precedent for a situa tion in which the head of the church is alive- but unable to dis charge his duties for long periods. The Apostolic Constitution does provide for the position of cham berlain tcamerlcngo) who would, upon the death of a pope, as sume charge of the administra tion of the church and organize the conclave to elect a new pon tiff. But Pope Pius XII never named a camerlengo. Should the present nope die, the election of a camer lengo from one of their number would be the first order of busi ness for the College of Cardinals. This most likely would be Eugene Cardinal Tisscrant, dean of the Sacred College. Similarly, if the Pope is fully incapacitated for a long period of time, a committee of cardinals would in all probability have to carry on the general administra tion of the church.
