'Hot Cargo' Pacts Rapped WASHINGTON UWTtie Nation al Labor Relations Board has ruled that "hot cargo" contracts between unions and common car riers violate the Taft-Hartley law. The question of the validity of such agreements has been before the board previously, but yester day's 3-2 decision marked the first time the NLRB has declared them unlawful. The board ruled the contracts valid and enforce able in 1949. A hot cargo clause generally provides that employes may re fuse to handle goods which the union brands as "unfair." The ruling yesterday concerned Teamsters Union Local 728 in At lanta. Ga. The board found that the local violated Taft-Hartley's ban on secondary boycotts by tell ing its members they could re fuse to handle shipments from the Genuine Parts Co. of Atlanta. The hot cargo clauses have been included in Teamster contracts with many truck firms. NLRB Chairman Boyd Leedom and board member Joseph A. Jen kins said ' the board should adopt a rule that a union's making of a hot cargo contract constitutes in itself evidence of union "induce ment or encouragement" of sec ondary boycott activity. Other board members took more restricted view. Member Stephen S. Bean agreed in finding a violation. However, he based his stand on a 1955 board ruling that hot cargo clauses are valid but may not be enforced by union appeals to employes. The fifth board member, Abe Murdock, dissented. Referring to the Leedom-Jenkins opinion, Mur dock said, "Never before has any member of this board or of any court adopted so extreme a view. Leedom and Jenkins, explaining their finding, said common car riers "are not free to decide, at will, to withhold the services they hold themselves out as able to per form, from any customer or class of customers. The case which brought yester day's NLRB decision came as a result of a strike which Local 728 called at the Rayloc Division plant of Genuine Farts in March 1956. Many truck lines hauling freight for Rayloc had hot cargo contracts with the Teamsters, and the un ion advised its members they could elect, as individuals, to re fuse to handle rayloc freight al though the union could not order them to refuse. The NLRB found that handling of Rayloc freight practically ceased after that. WASHINGTON Wi The Su preme Court, citing a June deci sion which said sex and obscenity are not synonymous, has ruled against a Chicago ban on a French movie, "The Game of Love." Unanimously, the high tribunal overturned Tuesday a decision by the U. S. Circuit Court in Chicago that had approved the ban. The Supreme Court's action, taken in a brief, unsigned order without the usual hearing of arguments, wes in line with decisions of re cent years limiting film censor ship. A Chicago ordinance requires censorship of movies before their public showing. If the Chicago Po lice Board finds films immoral or obscene their exhibition may be prohibited. Times Film Corp., distributor of "The Game of Love," in at tacking the ban. stressed artistic merits of the film and said it had been shown in more than 150 cities in this country. Felix J. Bilgrey, the company's attorney, said in New ork Tues day the court's ruling "may spell the end of censorship of the con tent of motion pictures." As far as censorship is concerned, he said, the decision puts movies in the same category as books and newspapers and "will discourage municipalities from trying to cen sor films." In Chicago, Police Commission er Timothy J. O'Connor said: "I still think the movie shouldn't be shown. But I have no choice in the matter. The law is the law." In overturning the circuit court, the Supreme Court referred to the June 24 decision which involed ob scene literature. The June deci sion war that federal and state governments may outlaw obscene material. Such material was defined as that which "deals with sex in a manner appealing to the prurient interest," that is, "having a ten dency to excite lustful thoughts." But the June opinion, written by Justice .Brennan, explained further: "The portrayal of sex, e. g., in art, literature and scientific works, is not itself a sufficient reason to deny material the con stitutional protection of freedom of speech and press. . ."
