OREGON PAGE THREE Election Measures (CMtlaued from paf e 1) Under the present constitution, opponents of any tax measure can block passage ot the law by use of the referendum within the 90 days following the end of the legis lative session which has passed the particular tax law. Oregon's referendum law provides that 5 . per cent of the number of regis tered voters who voted for supreme court justice in the pre ceding general election is all that is required for the referendum (normally about 20,000 out of about 700,000 total registered voters in the state). REFERRAL Thus, any tax law passed by the Legislature must face the pos sibility of referral by a small pres sure group. If the tax law is referred, it is held in abeyance until the next - general election (usually about a year and one half) when the people can vote on the measure. Legislators, and tax experts, have stated that this fear of refer ral has affected the voting of the Legislature and has had an t adverse affect on any attempt to work out an equitable tax program for the state. Passage of the 45 per cent income surtax by the 1953 Legislature has been blamed on this fear of . referral of any other tax measure needed to raise the necessary funds to meet the expanding needs of the state. The provisions of the income tax law allow increases or reductions the rate merely by action of the Legislature without the possibility of referendum. AMENDMENT ' . If the emergency clause amend ment Is passed by the people, certain safeguards against abuse of the use of. the clause would re main: . - 1. Proposed tax legislation would still have, to pass both houses of the Legislature. - 2. The governor could veto the bill as a whole, or he could veto the emergency clause attached to the bill. 3. The tax law could be initiated by petitions containing signatures of 8 per cent of the voters and then placed on the next general, or special election, for vote by all the people. 4. Members of the Legislature, if they passed stringent or un workable laws,' whether tax or otherwise, would have to face the votes of their constituents in the next 'general election. TAX PROGRAM Members of the Legislative Committee have stated that pas- u of ProDosltion One would permit the legislators to work out a more equitable tax program for the state than now exists. It would permit all future legislatures- to work out sound, balanced, long ranee tax programs. Opponents of the ' amendment state that if the people of Oregon wish to -retain control -over state taxes', they pay then they must vote no on Proposition One. It is felt by those opposing the amendment that due to the restric tions placed on the Legislature in' tax matters Oregon has retained; a much more simple tax system! than other states. Many of the states- allowing the use of the emergency clause on tax laws re-1 quire that two-thirds of the Leg islature, must approve the attach- WKatsthe troth afattlrWy? ment of emergency clauses to such laws. The Oregon amendment would allow use of the emergency clause on tax laws with only a simple majority. PASSAGE Passage of Proposition One would remove the restrictions of the referendum from tax laws, op ponents of the measure point out, so that any tax measure, or change in existing laws would become law immediately upon signing by the governor or passage over his veto. Use of the emergency clause would mean that the tax law would go into effect immediately and the people would be unable to repeal it in less than from 18 to 22 months.lt is then conceivable that if the people repealed the tax law, the Legislature could repass the bill aver the protests ot tne peo ple and it could not then be re pealed for another 18 to 22 months. If the legislators completely ig nored the wishes of the people, then this process could go on and on, those opposing Proposition One state. They indicate fear of pas sage, and perpetuation, of a state sales tax. in this manner, if the Legislature so desired. OPPONENTS It isalso feared by opponents of the emergency clause that it is more than just a means of work ing out an equitable tax program; that it is a direct attack on the referendum, one of the. safeguards of democratic government. As the referendum and initiative were pioneered in Oregon, it is felt that these, constitutional provisions have fostered and preserved the state's progressive legislation in various fields, those favoring re tention of . the constitution as it now stands argue. Proponents of the emergency clause sincerely feel that passage of Proposition One is necessary and essential to the healthy tax climate of the state and urge ap proval by the voters. Opponents of the measure just as sincerely arsue that a vote against Proposition One will retain for the people of Oregon the right to stop bad tax measures and keep control of the taxes paid in the hands of the- people. It is up to the individual voter to decide for himself which course he, or she, believes is best for the state and so vote. fw& 1 fir' 7 A kidnao-robberv similar to that pulled off in Klamath Falls about three weeks ago was duplicated in Vallejo, California Sunday night.1 However, the pair of gunmen be came much more entangled in their business during the Vallejo attempt.
