WASHINGTON (UP)-The Jus
tice Department has asked the
Supreme Court not to hear Gov.
J. Bracken Lee's tax suit against
the government on grounds he has
no legal complaint.
Lee, governor of Utah who was
recently defeated for nomination
to a third term, is protesting
against the use of his income tax
iponey lor foreign aid programs.

aid will cause Utah to lose rev
enue because Utah's income tax

In a memorandum died by Sol
icitor General J. Lee Rankin, the
Justice Department said the Su
preme Court has ruled In the past
that similar allegations "plainly
had no substance."
The memorandum said the Lee
argument "also seems to be pred
icated on the incorrect assumption
that the state has no alternative
but to allow its residents a deduc
tion (or federal income taxes."'
The department noted that at
least 16 states do not permit such
deductions.
