(, Sen. Mundt (R-SD) said the Con stitution and the laws contain a gap which "might sometime rise up to cause confusion and uncer tainty," and he added: ! "The best time to act is when we do not have that kind of situation before us, and I favor Congress working out some Itind of satis factory solution," , Sen. Watkins (R-Utah) said in a separate interview he considers it "desirable to see if we can't find a satisfactory solution," and Sen. Bastland (D-Miss) agreed "it's a question that ougRt to be studied." At his news conference yester day, Eisenhower was asked if he had given any thought to the Con stitution's silence on the question of who should declare a president unable to perform his duties. He said the subject should be carefully studied by Congress and the attorney general, adding It would be good for the country to work out the matter so that doubts would be resolved. Legislation to this end has been Introduced in the Senate and the House, but no hearings have been held. Sen. Payne (R-Mnine) has of fered a bill under which a presi dent If he felt physically unable to aiscnarge his duties properly, would notify Congress. The vice president then would assume the presidency's powers and duties but not the title until the President notified Con' giess he was able to assume them again. If a president were unconscious or paralyzed and therefore unable to notily Congress of his dis ability, Payne's bill provides that the vice president shall advise the chief justice. Then the chief, justice would be required to appoint a panel ot three to five doctora, each of whom would examine the President and submit a report. If they all con cluded the President was unable to perform his duties, the chief justice would notify Congress and the vice president would take over. , In the" House Rep.
