Abbott mur der esse to Invoke Divine guid ance in deciding whether the de fendant is KUilty or innocent. Whitnev voiced this plea yester- d.v shortly after A?st. Dist. Atty. Poller Emerson demanded the death penalty tor "one of the most foul, most abominable crimes ever committed in California." This was the kidnap-murder of 14-vear-old Stephanie Bryan of Beikclcv. It ftuparemlv took place shortly after 4 p.m. April '.'8 while she was relurnmg home from school. Les than three months later. Stephunie's purse and other be lonqincs were found in the base ment of Abbott's home In Alameda. And on July 20. her body was dis covered in a crude grave near Ab bott 's Trmity County mountain cabin. ' Replvlna to Emerson's demand for the death penalty, Whitney ad vind the Jury to disregard Emer son's sucqestion that there is no doubt about Stephanie's kidnaper and murderer. There is a question of doubt in this case." Whitney declared. '"Ii there were not. you and we would not b1 here. Th'.s is a murder case, and I hop- to Ood that you will get your advice from above, because a inpn's life is at stake." Whitney declared that the state has never established by innu endo, speculation, or anything else, a reason why Burton Abbott is suoposcd to have kidnaped and killed Stephanie Bryan. ! "There is a reason for every thing that people do, unless they are complete lunatics. "There is no shred of proof that this man is a lunatic. This man is Just as sound, Just as intelligent p.nd Just as responsible as any other student at the University of California. Whitney went on to say that no witness has ever connected Abbott with Stephanie Bryan. The defense attorney said no witness ever testi fied the two even met in Pring's Douphnut Shop near Stephanie's school. "There Is nothing there except the insinuations made by Mr. Em erson. There is absolutely noth- Jnpr. Earlier Emerson asked the jury to weih every theory and argu ment against what he called the four fundamental facts of the cave. He listed them as: 1, The fact that Stephanie's body was found at Abbott's cabin. 2. Th fact that Abbott was at the cabin on the weekend the girl disappeared. 3. Tiie fact that Dr. Paul Kirk, ft criminologist, testified he found fibers, and hairs matching Steph anie's In Abbott's car, and that he found soil from Stephanie's grave on Anoott s boots. 4. The fact that the defendant was "untruthful" with regard to tne case. "Those four facts alone are enough to convict this defendant," Emerson said.
