Jury Boosts
Pay For Land
A circuit court Jury late Friday
awarded C. H. and J.- F. Kelly,
Klamath Basin ranchers $11,000
plus legal fees at the conclusion
of a suit filed against them by the
city over restricted easement on
90 acres of land adjacent to the
municipal airport.
The action was instituted in
Judge David R. Vandenberg's
court after Uie Kelly brothers re
fused to accept $6,750 for allowing
he restricted easement on their
land. The land, is needed to facili
tate construction of the Klamath
Falls Jet Interceptor base.
Attorneys Dick Maxwell and Ben
Goddard who represented the
ranchers, contended that instruc
tions on Uie land eliminated possi
bility of its development as a sub
division. Under the terms of the
restricted easement, no buildings
could be erected on the tract and
not more than 25 persons would
be allowed to congregate there.
When the jury announced its ver
dict after three hours deliberation.
City Attorney Henry Perkins said
it would be up to the city council
to decide whether the case should
be appealed.
The defendants asked $15,000 plus
$5,000 legal fees. Judge Vandenberg
will decide what remuneration
Maxwell and Goddard will receive.
Court costs also, must be paid by
the city.
