Crawford yester day scotched reports that a Jury In the Victor Wolf murder hearing would serve only In an advisory capacity. . Judge Crawford said as the hear ing opened that he would be bound by the decision of the jury and that the Jurors "will try the case." The court proceedings, however, were described as a hearing and not a trial. The court will deter mine the degree -of guilt and the sentence to be imposed on Wolf for slaying Portland attorney Ker mit Smith. Wolf has admitted the killing but claimed that Smith's wife, Marjorie, helped him. Mrs. Smith has been found Innocent of that charge. Judge Crawford denied defense motions for a hearing without a Jury and ruled that the Oregon Constitution prohibits waiver of a jury in first degree murder cases. Judge Crawford also announced he would rule out any possibility of a. manslaughter verdict unless evi dence was introduced to make such a verdict valid. Multnomah County Dist. Atty. William M. Langley, for the first time since his election, appeared as prosecutor in a major case. He said he had every reason to be lieve that Mrs. Smith would be subpoenaed as a witness In the case. LEWIS, Wash. 11 A one time prisoner of the Chinese Com munists told an Army court of an escape plan worked out with LU Col. Paul V. Liles involv ing use of a helicopter to rescue 65-70 Americans held captive in North Korea. Capt. Chester W. Van Orman of Gardiner, Me., testified as a de fense witness at the court martial of Liles, 39, of Birmingham, Ala., on charges he collaborated with the Communists while their pris oner. Van Orman said he and Liles hatched the escape plan while both were prisoners in Pyongyang in 1951. It had two alternatives in the event the helicopter plan fell through. The witness said the plan and a map of the area around the camp were reproduced on a small piece of paper which they hoped to smug gle to American forces. . The paper was given to another POW. M. Set. Clifford L. Neel of Ft. Knox, Ky., who hid it in his belt. The scheme was to appear to cooperate with the Communists and persuade them to et Neel be repatriated, Van Orman said. Neel was to give the map and escape plan to American Army officers when he was once more in friendly hands. The plan failed because the Com' munists would not repatriate Neel, Van Orman testified. seedlings, 300 superior ones have been selected to start these master trees. They think the reason that the 30o are genetically superior. They will be watched lor the next five years. If these trees keen up their pres ent rale of growth, the .foresters will know they have the foundation for forests of trees which are much bigger than they are now. "Those trees which prove to be genetically superior will be used to produce seed for a progeny that will glow-wood quicker and cheap er in the 21st century. The fast growing trees also will be studied for developing strains resistant to diseases and perhaps even in sects," the Forestry Department saia. Timber companies alsa are co operating. The project is financed by the state tax on 4 cents on each 1.000 board feet of timber harvest ed in Oregon. Knight Urges Safer Driving SACRAMENTO, Calif. (IP) Gov. Goodwin Knight has called for an all-out drive by state and local officials against the "alarming trend" of traffic deaths in Cali fornia in the first five days of December. Describing himself as "shocked" by 53 fatalities In five days. Knight Tuesday ordered all state depart ments to "take all possible steps to stop this needless loss of life and Jimb . ... so many people seem unable or unwilling to help themselves. At your local food store Brucker Confers With Korean SEOUL Ml U.S. Army Sec retary Brucker talked nearly two hours with President 8yngman Rhee Wednesday and said after wards "It will take time" for South Korea and Japan to settle their disputes. The secretary expressed hope for the two to resolve the quarrel which worsened when South Korea threatened recently to "shoot and if necessary sink" Japanese fishing boats which ventured inside the Syngman Rhee line, 80 miles off Korea. Brucker first top ranking offi cial of President Eisenhower's administration to see Rhee in the crisis indicated he feels strongly on the need for America's two allies to get along. He implied he conveyed some of these feelings to Rhee. Talking informally with newsmen Brucker commented; "Communists must be gloating," over the ROK-Japan difficulties.
