Siskiyou Road Ruling Given

day that the Siskiyou County Board
of Supervisors must start a new
proceeding U it wants to acquire
the John Ladd Chrome mine road
for a county highway.

Talks Continue
SAN FRANCISCO (UP) Federal
Conciliator Arihur Viat planned to
meet sometime today with com
pany and union representatives in
continuing attempts to find some
way of Milling the telephone
strike.
A 46-mlnute meeting between the
Pacific Telephone and Telegraph
Company and (he CIO Communi
cations workers of America ended
yesterday in failure. Viat said
neither side would change its po
sition. The CWA represents 17.500 of the
22,000 telephone company employ
es who left their Jobs in Northern
California and Nevada a week ago
yesterday to back demands for
higher wages.
As negotiations dragged on with
no settlement in sight, strikers in
San Francibco and Oakland staged
demonstrations before telephone
company offices yesterday.

Proceedings were begun last
spring in Siskiyou County to ac
quire the road by means of the
"viewer method". On April 12. the
board held a hearing on the mat
ter. At the hearing, it adopted a
morion "that the condemnation pro
ceedings on the John Ladd Chrome
mine road be dropped."
"Since no condemnation proceed
ine had been started," Brown said,
"we can only construe this action
as a rejection of the report of the
viewers. . . ."
The question tnen arose whcUiei
the board, without beginning a new
proceeding, could reverse its prior
decision and now accept the report
of the viewers. The county district
attorney advised It to file a new
petition.
"We agree with the district at
torney," Brown said. "Under the
law, not only is the procedure he
suggests safe, It is indispensable if
the viewer method is to be used."
The viewer method is a device
to permit an "expeditious settle
ment" of relatively small claims
without the expense and formality
of a proceeding in condemnation.
Brown said the method has been
described as one providing for a
"preliminary and informal deter
mination of damages by some
board or tribunal other than a
court."

Ike Prepares For Official Visitors, Brother Milton

Eisenhower scheduled busmess
conferences today with Sherman
Adams, his chief assistant, and
other members of his staff In his
role ot directing the government
while recovering from the heart
attack he suffered Sept. 2-1.
The President also planned to
visit with his brother, D:-. Milton
S. Elsenhower, president of Penn
sylvania State University, and Mrs.
Eisenhower. He will follow his
usual recovery schedule of sun
bathing and reading.
No official callers were expected
today but secretary of State John
Foster Dulles will fly in from
Washington tonight to meet with
the President for the second time
Wednesday before departing for
the Big Four foreign ministers'
conference in Geneva.
Defense Secretary Charles E.
Wilson and Adm. Arthur W. Rad
ford, chairman of the Joint Chiefs
of stall, saw the President Mon
day on government affairs and re
ported the President in good spirits
and making rapid strides in his
recovery.
After seeing the President, Wil
son said he thought defense spend
ing in the next fiscal year may be

Mr. Eisenhower was out of his
bed for more than an hour and
10 minutes Monday. In the morn
ing he was lifted from his bed to
an easy chair on the sun terrace

the autumn sun for 40 minutes.
In the afternoon, the President
again sat up In his chair, but in
side hut room, for 30 minutes and
visited with his wife, his brother
and Adams who kept him up to
date on federal steps to relieve
flood suffering and damage in the
northeast.
Wilson apparently covered
broad range of topics in his meet
ing with the President. During
their conference the President ap
proved the recess appointment of
Lt. Gen. Randolph McC. Pate to
be commandant of the Marine
Corps with the rank of general for
a period of two years beginning
Jan. 1. 1058.
