T u e s d a s ' toiil '-ws .: V'O.OW shares, .- Be Forced To Retire WASHINGTON W Twenty eight of Uie 347 federal Judgos holding lifetime posts would jo forced to retire, because they are 15 or over, under a proposed con stitutional amendment passed yes terday by the Senate. But since it may be years before there Is final action, presumably few if any of these same judges would be affected. v - Besides the mandatory retire ment provision, the proposal would fix the size of-the Supreme Court at sine justices, thus preventing any future attempt to enlarge it. Senate approval, sending the measure to the House, came on a vote of 5S-19, comtortably more than the required two thirds. All 43 Republicans present voted for it. So did 15 Democrats. Eighteen Democrats and the lone Independ ent opposed it. The administrative office of the U.S. courts said today in response to a query that 28 federal judges now are 75 or older. None of the nine Supreme Court justices is that old, however; Justice Frankfurter, the oldest. Is 71. ' Federal judges now may retire at 72, but there is no provision forcing them to retire at any age. They draw full pay for life. Sen. Hennings (O-Mo), who op posed the proposal, said in the debate that one motive for it might be a desire to force some judges off the bench. Most of the present jurists were appoint ed during the 20 years of Demo cratic national rule. But Sen. John M. Butler (R Md), author - of the proposed change in the Constitution, said the reason for the age provision was his conviction that most judges nave slowed down consderably by the time they reach 75. Before passage, the Senate elim inated another section by -Butler which had political overtone's. It would have, barred any Su-" preme Court member from run ning for president or vice president until five years after be left the court. ... If the House approves the Butler amendment by a two-thirds vote, it would go to the state legisla tures. Thirty-six of them, would have to approve it within seven years for the provisions to go into the Constitution.. . Butler said It was designed to forestall any repetition of the 1937 plan of President Franklin D. Stevenson Given Physical Check CHICAGO I Adlal E. Steven son was back in Passavant Hos pital today for a physical check up after making his first public appearance yesterday since his April 12 kidney stone operation. The 1952 Democratic presidential nominee's physician, however, said his "health Is excellent and his recovery ahead of schedule." Stevenson is expected to remain in the hospital two or three days. He is due to make a speech May ja at Meridian, Miss. Yesterday he visited campaign headquarters of Sen. Paul H. Douglas (D-Ill and told Douglas' supporters, 'Tve enlisted to serve in any way I possibly can to as sure the return of Sen. Douglas to Washington." New Rocket Revealed WASHINGTON Ul A rocket- powered supersonic guided missile system, designed to be used lrom airplanes - against airplanes, was announced by the Defense Depart ment last night. The weapon, known as the Sper- ry Sparrow I, Is-"fully maneuver- able at supersonic speeds, yet ngnt and compact enough to be carried In multiple units by fighter-tspe jet aircraft," the announcement said. The Defense Department called the Sparrow a "guided missile sys tem" rather than a guided missile, apparently implying that It Is more than a missile. The Navy disclosed It is train ing ship and shore personnel for use of the Sparrow by carrier based jet aircraft both in the At lantic and the Pacific fleets.
