The case was termed "shocking" by Judge Michael L. Igoe after Dr. Jnhn . Waltrr of suburban Wau kegan testified at a hearing on Montgomery's writ of habeas corpus. The Negro prisoner claims that evi dence that would have cleared him was not Introduced at his trial. Dr. Walter Identified a photostatic copy of a record of his examination ct Miss Mamie 8now. the woman Montgomery was convicted of rap ing. He was sentenced to life Im prisonment at Waukcgan on June 8, 1934. Walter said the cupy showed no mention of Indications of rape. He said he called the case and that a careful examination convinced him Miss Snow, who was S3 years old at that time, had not been raped. He was booked on chargea of attempted assult and robbery while armed, assault with Intent to kill and carrying a concealed weapon. The proprietor, Mrs. Vetha M. Howe, told police this story: While she waa drawing a beer for the only customer In her tavern at 13:30 a. m. today, he pulled out a revolver and demanded the tills cash. She reached for the till and with the other hand waved to a passing car. She told the robber it was the night watchman who waa coming to pick her up. The man looked out the window and Mrs. Howe grabbed a club from under the counter and hit him on the head. The blow had no apparent effect and the man whirled and fired at point-blank range. He then ran out the door and fired again. She called police and a prowl car picked up McNeil near by. When a revolver taken from him waa found to be loaded with live ammunition, two cartridges of which had been fired, police looked for more evi dence.
