April 14 111 Efforts of the Yakima and Nez Perce In dian tribes to halt construction of McNary dam drew the answering fire of government witnesses today. Attorneys for the two tribes closed their case yesterday. The action is based on tho contention Unit, con struction of the Columbia river dam would damage the river's salmon runs and thereby violate a fishing right treaty signed In IB',5. A motion to dismiss the action was denied In court yesterday, but federal Judge 8am M. Driver said he would retain the privilege of en tertaining the motion Inter after hearing all the evidence.
