Han rta held in his report to Secretary of Interior Ickcs. . Judge Hanna, formerly of the New Mexico supreme court, held in his findings of fact that the petitioners failed to establish exclusive rights, to tidal waters for fishing, or the exclusive possession of definable territory; that here had been abandonment of exclusive fishing r i g h t s- in tidal waters through acquies cence and that evidence of abo riginal rights to tidal waters dealt largely with fishing for io mestic use, which is "now no. so essential." The judge further held that claims for land areas were not sustained or defineable "upon evidence taken." However, some aboriginal rights were found to exist and the secretary was advised that a quick and final settlement of the entire question is imperative. "How far Indian rights have been impaired or may become in volved, does not appear from the evidence . . .," the report said, but the conflict of interests "should be settled once and for all by some solution of the prob lem, without too much delay. In this connection it might also be said that the largest industry of Alaska (commercial fishing) is now laboring under real diffi culies through lack of solution of aboriginal rights of Indians." "It is clear from the evidence as a whole," the judge added, "that these claimants do not pos sess extensive aboriginal rights. only in part abandoned, and that no extinguishment of such rights has otherwise been had." - The extensive evidence taken at hearings at Kake, Hydaburg, , Klamock and Ketchikan, Alaska, and at Seattle, filled 15 volumes of 2700 pages of transcript, the report noted.
