March 5 MP) The supreme court upheld today the death sentence imposed on Thomas H. Robinson Jr., for the 1034 kidnaping of Mrs. Alice Speed Stoll, Louisville society matron, Justice Black delivered the court's 7-2 opinion. Justice Rut ledge wrote a dissent In which Justice MurDhv agreed. Robinson was sentenced under the Lindbergh kidnap act, which allows for the death sentence In a ransom kidnaping. His appeal to the supreme court hinged on Interpretation of a provision in the act that the death sentence "shall not be Imposed by the court if, prior to its imposition, the kidnaped person has been liberated unharmed." His counsel argued that any injuries suffered by the kidnaped person must be permanent and in evidence at the time sentence is pronounced, else the death penalty may not be imposed. The attorney said that at the trial of Robinson which resulted in the death sentence, no evidence was given that Mrs. Stoll "then was sufforing In any manner from effects of the alleged kidnaping." Justice department attorneys contended the condition of the kidnaping victim at the time of release determines the applica bility of the death sentence. They said that when Mrs. Stoll was freed she had head injuries and was in a state of general nervous exhaustion. VISITS IN CITY 1st Lt. Lynn McDaniels, wear er of the Silver Star for gallant ry in action, is in Klamath Falls for several weeks from Barnes General hospital at Vancouver, Wash., where he has been receiv ing treatment for wounds re ceived in action August 21 in Franco. McDaniels was a mem ber of a tank destroyer unit. McDaniels and his wife, the former Margaret Mahoney, and their young daughter, Mari lynne, will be at the J. A. Ma honey residence, 737 N. 9th. dur ing their stay in Klamath- Falls. The lieutenant's mother, Mrs. Tillie McDaniels, is now making her home in Vancouver, Wash. Following treatment for leg wounds in an overseas hospital, Lt. McDaniels was first sent to McCaw General hospital at Wal la Walla, Wash., and later to Barnes. He will return to Barnes for additional treatment. DATES SET FOR 4 Circuit Judge David R. Van denberg presided at the March docket call Monday morning and set the dates for trials of four criminal cases now pending. Dates are as follows: State vs. Edward William Qoe dert, March 12. State vs. Joseph Raymond Se gobiano, March IS. State vs. Samuel F. Ash well, March IS. State vs. Herbert Daniel Stev ens, March 26. Judge Vandenberg said he would set five other cases at the April docket call. These cases include State vs. Baker; State vs. Thompson; State vs. Gathwrlght; State vs. Hayter, and State vs. Young. Hispanic America Classes Held Hare John T. Ganoe, Ph.
