PACE TEN HERALD AND NEWS, KLAMATH FALLS, OREGON T WASHINGTON, Oct. 23 W) "News-gathering agencies are not public utilities and should not be made such by judicial ac tion, The Associated stress said today in a brief asking the Unit ed States supreme court to re verse a lower court ruling that the AP must change its member ship by-laws. The brief, submitted in an ap peal from a summary decision by a special federal threc-judpe courjj of the southern district of New' York, concludes that "so grave a step as transferring the press from the field of private enterprise to the status of a reg ulated public utility is the last thing that should be done at all so long as any possible alterna tive exists." The appeal is the latest devel opment in the government's civil suit, under the Sherman anti trust act, to force The Associated Press, a cooperative, non-profit organization, to change its mem bership structure and make its news reports available to any ap- I plicaut. Named as defendants in the suit, in addition to the AP, were its 18 directors and the ap proximately 1200 other members in the United States as a group. The government lias until No vember 6 to file its brief and the AP's reply brief is to be filed the week of November 13, the week when the supreme court is to hear the case. Ilohnan, also a republican, listed $1083.55 with' $13,021 spent by his campaign committee. The top Idaho report was that of lien Johnson, unsuccessful republican, who listed $2172.
