PRICE FIVE CENTS City Bonds Refused By Local Bank Alleged Error in Proce dure Claimed by Suc cessful Bidders The American National bank, successful bidder for $160,000 worth of Klamath Falls street paving bonds, 'gave notice late yesterday afternoon that it would re fuse to take delivery of the bonds because of alleged il legality in the proceedings which led up to the opening of bids for the bonds. The alleged mistake in legal procedure, set forth in an opinion by D. V. Kuy kendall, attorney for the bank, is that five, days had not elapsed from the time of introduction of bond ord inances to their passage. Through this error, the bank claims, the bonds are illegal. In its communication to the city, the bank requests the city to refund the am ount of its certified check which accompanied their bid, to the amount of $7,034. If the bank can successfully prove to the city council next Monday night that the paving bonds are Il legal, the city must, retrace Its steps, again pass the bond ordinance and re-open bids for tho sale of the paving bonds. If not, then litigation over the dispute will probably take place. City Attorney J. H. Carnahan was reluctant to go Into details on the dispute, but did Issue tho fol lowing statement: "It is my opinion that despite the claims cf the American National bank and their attorney, that the . proceedure leading up to the aalo of the bonds to the bank was legal." E. M. Bubb, cashier of the Ameri can National bank had the following comment to make on the bond dis pute: "In view of our attorney's opln isn on the validity of the bonds, w do not feel safe in taking deliv ery of tjhc bonds and for that rear son have notified the city that ..ve will not take them.
