Elliott today on a charge of malfeasance in office comes as a distinct blow-to Klam ath county and its people. Coming as it does almost on the eve of his induction into office as distinct attorney, it places the accused man under a serious handicap, and one which it will be hard for him to overcome for the time being, at least. .- With the utmost sincerity, the Evening Herald urges that the spirit of fair play prevail; that people generally withhold their opinion as to Mr. Elliott's guilt or inno cence until he has been accorded a fair and impartial trial by jury. The deliberations of the grand jury are of necessity secret in their nature. All of the evidence which was given and all which might have transpired behind those locked doors may never become known. The indictment simply means that the grand jurors had reason to delieye that a crime has been committed and that sufficient evi dence was produced to convince them that Mr. Elliott should be held for trial. ' , It is indeed unfortunate that the newly appointed dis: trict attorney should bear this added burden when he takes office. In fairness to all, he should, be accorded a speedv and impartial trial. ' , - The Evening Herald is frank to say that it did n6t .approve, of his appointment to'that office. But having been appointed, The Evening Herald stood ready to support him just so long as he proved himself an able, fearless and unbiased prosecutor. (P) Chief Rheamount, Indian spir itualistic medium, arrested several weeks ngo on a warrant charging assault on a fellow medium In the ' midst of a seance, was" freed today in district court, when the ' com plainant, Convers Nickerson, failed to appear. - The warrant, sworn out : four years ago, charged that Rheamount struck Nlckorson on the head "with a guitar when the latter entered a room in which the Indian medium was conducting a seance at the ako Pleasant spiritualistic colony near here. It was said that Nicker son had thrown a flashlight on Rheamount, spoiling the seance. Nickerson Is at present on the" Pa cific coast. Two Autos Crash On Ashland Road H. Brink and Carl Schlukeise of Oakland were severely injured this morning and A. Devorl faces arrest on a charge of reckless driving as the result of un automobile acci dent on tiie AshlandKlamath Falls' highway 30 miles east ot , Klamath - Fulls. BRIDGE TOTTERING Structures to be Completed Before Snow Flies this Winter A new bridge will be built across Lost River at the state line and the Harpole dam bridge just vest of Bonanza will be rebuilt before the snow- flics. County Judge R. II. Bun nell announced this morning. Declared unsafe, the cofufy court will close, the, Harpole Dam bridge across Lost River to traffic and In the near fuUire will advertise for bids for the construction of a prac tically new bridge. .The feature of the new Harpole Dam span, will be that stope abut ments will support the structure and that Uie bridge will be shortened from a 250. feet bridge to an 80 foot bridge. From the material that will be obtained from the old bridge, the new frame bridge will be built Provision will be made in the recon struction, for a steel spun, when the traffic that will be routed over the bridge warrants such a move, Judge Bunnell said. 17 Years Old The Harpole Dam. bridge is locat ed on the Poe Valley markot road, approximately 20 miles from Klam ath Falls.
