Lodge of Klamath Falls, mannger of the Big Basin Lumber company there, was found guilty In Judgo Taylor's court hero yesterday nflcrnoon of having driv en his Dodge car In "a careless and Imprudent manner" last Sunday on tho Pacific highway, thereby caus ing an accident, and was fined fbO and costs, says tho Modford Mail Tribune. Tho costs were heavy, as there wore so many witnesses, and in nd dltlon ho had the attorney's foe to pay. Besides ho lost about three days time here. Hence his over Sunday visit td Modford proved quite expensive; ! j His arrest grew out of the fact that on tho Pacific highway near Phoenix last Sunday his car ran ln7 to tho rear ot a wagon, In which Mr. , and Mrs. J. C. lierford and young son of Talent, enrouto to Modford, hurling them from their seats and damaging the wagon. " Mr. Lodge's main defense was tnat tho brakes or his car refused to function properly when, as all tho evidence showed, he applied them about 100 feet in tho rear of the wagon, and therefore he had no op tion oflior than to ram tho wagon or go off tho road. Ho and others j In tho car also claimed that the j pavement was wot, although this i featuro was refuted by many peo- plo nearby who witnessed the acci- I dent. . The Klamath Falls man's own ! witness, an auto mechanic, showed i there was nothing in his contention 1 about brakes failing to work. Mr. Lodge had previously testitlod that ho was only going 28 miles an hour. After tho accident Mr. Lodge em ployed a local mechanic to test out the brakes of his' car, and this me chanic stated on tho witness stand that in tho tests ho made nt 2S miles an hour he was ahlo to stop tho car within .10 foet. Lodge nlso recompensed Mr. Her ford for all damago to the lattcr's wagon. Paint and Wallpaper No matter how yon baild your home, looks play an Important part when you sell.
