filed with thin commission an appli
cation for authority to Increase Its
water rates In tho city of Klamath
Falls.
After due and legal notice to all
Interested parties the above entitled
matter came on for hearing and In
vestigation before tha commission at
the City hall Klamath Falls, Oregon,
on the l.r.th day of October. 1U20, at
the hour of 9:30 a. in., at which time
and placo witnesses were called and
their testimony taken; and, the com
mission now being fully advised In
tho premises, the matter Is ready for
final determination and order.

This application was based upon
thegrounds that during years 1917
to 1919 the prices of material and
labor had Increased abnormally, and
that oneratlnu costs had also In
creased to such an extent that the In
come derived during the yea'r 19tB
prorided a return of less than 2ft
while It Is necessary to pay 7 on
borrowed caolul. also that during
the year 1920 it 'has bron nocessary
to larrclr Increasn the capital inrest-
meat, and' that further Inrestment In
olant Is necessary to provide ade
quate and ratlsfactory service; that
following 1919 the present rates win
not only nrovlde no return, bur In
fact will rfauio an actual deficit In
the operation of the utility. Also
that on July IS. 1'Jl". the public
service commission of Oregon found
a physical value of the applicant's
water system, and fixed a deprecia
tion rate to apply to aamo which is
found to be Inadequate.

fort by tho utility to cover both Issues'
resulted in the tiling ny it. on April
1, 1922, of Supplement No. 10 to Its
P. 8. C. Or. No. 2, which named In
creased rates (or practically all Mu
ter service rendered at Klamath
Falls, and which was scheduled to
become effective May 1, 1922. As
this matter was already formally be
(ore thin commission, tho operation
of tho supplementary tariff, was, on
April 29. 1922. suspended "until the
drat day of July, 1H22. unless other
wise ordered by the commission,"

tion of this utility and fixed a tolal
valuation (or rate making purposen,
as of December 31, 191G, amounting
to ri78,135.00. and also fixed a
rate of depreciation to bo used by
the utility In the various accounts
as an operating expense. On account
of the action of chemicals in the soil,
the depreciation rate as fixed at this
time on the distribution Rystein has
been since (ound to bo Inadequate,

engineering staff has made full and
careful Investigation of the operat
ing oxpensos, the condition of tho
plant, and of throe years net addi
tions and betterments made to tho
plant since the former valuation was
fixed, nnd reports that there has
been a total Investment In new plant
during the years 1917, 1918 and
1,919 of 113,160.00. thua making a
total capital Investment In plant of

It Is to be noted that although cer
tain readjustments of general expenses-and
depreciation allowances have
been made that a considerable defi
cit from operations for the last two
ear has occurred It was estima
ted by the utility that It will be pos
sible to reduce this deficit. Although
It should be entirely eliminated, our
own Investigation hIiowh little Indi
cation of their ability to earn a re
turn n excess of I under the ex
isting conditions.
With this wutor utility earning
practically no n turn. we are con
fronted with the necessity of requir
ing an additional investment for fire
protection, and It must bo evident
that If money Is to be secured for
this purpose, an Income must be as
sured at the time that a requirement
for additional Invtstment Is made. It
Is our purpose to reiulro tho addi
tional investment for the necessary
fire protection, and the necessary re
turn thereon can only be provided
through Increased rates.

franchise, provides for tho free use
of 10 hydrants and presumably other
facilities, as originally Installed, for
fire protection such as tho reservoirs,
wells and pumps, etc. For the addi
tional equipment, the rate now In if

utility has proposed to Increase to
$2.S0 per hydrant.
In analysing the Inn' (Its of the
additional construction proposed, It Is
evident that tho rates filed by tho
Utility and suspended by the commis
sion do not place upon firo protec
tion Its propnr proportion of costs It
should be evident that the plant In
vestment, used (or both domestic nnd
(Iro protection, which Is over und
above that neceasary (or domestic
service should bo assignable to firo
protection.
At tho April 13th hearing. It de
veloped that, ulthough uddltlonal
(Ire protection facilities should be
Installed In the near future, tho city
woh operating upon u budget system
and any resulting Inereaso In rales
could not become effective until the
beginning of tho year 1923. It wa.s
also shown at this hearing that, ovoi
thought It was desirable that econom
ical for the city to own Its own hy
drants, this condition could not be
effected Immediately.
In order to meet such condition, we
are prescribing no rhango In rates
(or fire protection until tho begin
ning of tho year 1923; and aro also
making specific provision for u nntal
(or each type of hydrant, which rent
al would ceaso at tho time that the
hydrants wore purchased by thu city.
