Collection of Taxes Until Ihe council shall other wise l ordinance provide the, County Tax Collector hall collect all city taxes in the same manner and at the same tune as the stale taxes are collected, and all laws of the state fur the assessment of property and the levy .mil collection of general taxes, includini,' laws fur the sale of properly for taxes and the redemption ( the same, shall apply and have full clTcel within the city except as otherwise modified hy this charter. CiU Indebtedness The indebtedness of the city may be incurred hy bond issues providing for the city an aileipi.ttu waterelectric light and sewerage sys fin and other public utilities. In the event of the city owning its electric lighting system all moneys received in excess of operation and mainten "ice shall be applied in the redemption of electric light otitis. section oa. (a) Department of Water and Light : an entity In the event the city sliall'own its own water ai and lighting systems, or either of them, all property rights and obligation of the city in respect to water or light ing systems, shall be as far as practicable administeicd as an entity, and the City Council is hereby author ized to create departments and pass all needed rules ami tegulations for the carrying out of this provision of the charter. All contracts, records and muniments of title pei taming thereto shall be assembled and care fully preserved, and an account shall be kept of the assets, liabilities, receipts and disbursements, separate ami distinct from the accounts of the other depart ments. (b) Kates, Kegulations, Fines The City Council shall, in the event the city owns its own water system, by ordinance fix rates, establish regulations for thcusc of water by the consumer thereof, provide for the or deily administration of the department' and impose fines and penalties lor the violation thereof. Such qrdi nance shall establish a uniform system of rates for the use of water by the consumers thereof, from which rates tbere.shall be no rebate or reduction. Whenever the revenue from said water system shall produce a surplus over and above the cost of operation and maintenance and interest on the cost of construction ami the sinking fund provided by this charter for the redemption of bonds, it shall then be the duty of the city council to reduce the rates to con sumers'so that as far as practicable the people may re ceive the benefits of this department at not more than actual cost, plus a reasonable allowance fo"r deprecia tion and extension of said system. All consumers living outside of the city limits shall pay such rates as may be established and fixed by the City Council. , Section 69. Assistance and Kinploycs The City Council shall appoint n citv health officer, who shall act vith and un der -the direction of the mayor; it may also appoint a plumbing inspector and all such assistants sjiul em ployes as may be necessary to protect the Health of the city. Section 70. Qualification of Ilelatb Officer The health officer shall be a graduate of a reputable medical college, and shall have practiced medicine and havubeen n resident oMIic City of Klamath I-alls, prcgon, one year next preceding his appointment. "'', " - nraclicc medicine within the State of Oregon. Such health officer shall devote such time as may be neces sary to the duties of his office. ' Section 71. Qualifications of Employes The plumbing in spector and other employes shall be persons properly skilled and qualified for the efficient and faithful per formance of their respective duties, and shall pass a satisfactory examination as provided in this charter. Section 72. Regulations T.he council shall make all ordi nances and regulations which may be necessary for the preservation of the public health and the suppres sion of disease. Section 73. Police and Fire Department The council shall by ordinance provide for tbc establishment and main tenance of a Police and Fire Department, consisting of such employes as it may deem necessary. Section 74. Direct Legislation by the People The qualified voters of the city shall have power through Jhe initia tive's provided by this charter and the genaral laws of the state and by the Commissioners, to enact appro priate legislation to carry out and enforce any of the abovfe general powers of the city or any of the specified powers of the council. ARTICLE VIII. Executive and Adminiitrative Departments and Dutiet of the Corrurdationeri Section 75. Departments The executive and administrative powers, authority and duties of the city shall be dis tributed among three departments as follews: Department 1. Public Affairs, Health and Civic Beauty. Department 2. Finance and Supplies. Department 3. Streets and Highways, Light, Water and SewcrsParks, Cemeteries. Public Build; iugs and Grounds. Section 76. Public Affairs, Health and Civic Beauty The Com missioner of Department No. 1 shall have charge ot Department No. l. (a) He shall, unless otherwise provided by ordi nance, be the Judge of the Municipal Court of.the city; he sluill be ex-officio the head of the Police and Fire Departments. (b) He shall .see that all heaVth ordinance are enforced, and shall have supervision of the plumbing inspector, and general supervision of all foods and milk ofi'cred for sale within the city. (c) He shall have general supervision of the arch itectural beauty and make recommendations as to the color and style and character of buildings, pavings, sidewalks, as to him may seem advisable to the end of improving the city's appearance and beauty. (d) Powers of Arrest The Commissioner of De partment No. 1, and all salaried employes of the city whose duties appertain to the enforcement of any pro vision in this charter or any ordinance of the city re lating to health shall have the right and power to ar rest any person, or persons who violate any of the ordi nances, rules or regulations ordained for the promo tion of health. (e) He shall in connection with the health officer under ordinances, rules and regulations adopted by the City Council, or under any authority given by state law, properly isolate all contagious diseases, a record of which shall be kept on file in his office. A statement of all assets, liabilities, receipts and disbursements per taining to said Health Department, shall be kept sep arate and distinct from other funds. (f) He shall have general supervision of all pub lic affairs not otherwise provided in this charter. Section 77. m Finance and Supplies The Commissioner of De pa'rtmcnt No. 2 shall have charge of Department No. 2. ' (a) He shall be the purchasing agent of all sup plies for all departments of the city; he shall also be the city collector, and as such it shall be his duty to collect all water ren license fees, money of 'the city in the hands .of the County Treasurer, and all moneys due the city, and shall daily during banking 'hours pay the same to the City Treasurer, taking his receipt therefor. Said Commissioner shall furnish a good and sufficient bond for the faithful performance of his duties. (b) Fiscal Year Same as Calendar Year The fiscal year of the city shall commence of the 1st day of January and end on the 31st day of December of each year. (c) Public Moneys The Commissioner of De partment No. 2 shall.'under the power and control of the City Council,. have the- direct management of the revenues of the city except as otherwise provided by this charter.
