visions of -this act, In tbe states of
Colorado, Idaho, Montana, Nevada,
North Dakota, South Dakota, Oregon,
Utah and Wyomiag, and tbe territor
ies Arizona and New Mexico, three
hundred and twenty aores, or less, of
nonminerai, ooulriigable, uuresatved
ad unappropriated surveyed publio
lauds which do not contain merchant
able or milling timber, located in a
reasonably compact body and not
over one and one-bait miles in ex
treme lenxtb.
Section 2. That any person applying
to enter land uuder tbe provisions of
this aot eball make and subscribe be
fore the proper office an affidavit as
required by section 2290 of tbe revised
statutes, and in addition thereto shall
make affidavit ttiat tbe land sought
to be entered is of the character des
cribed ia section one of ibis aot, and
shall pay tbe tees now lequired to be
paid under tbe homestead Ibwb.
Section 3. 'that Buy person who has
heretofore perfected en entry under
tbe homestead taws of one hundred
and sixty acres, or less, shall have
tbe right to make an entry under this
act, ot an area which together with
tbe former entry, shall not exceed 32U
acres. Ibat any homestead entrymau
now occupying lands heretofore en
tered by bim snail have tbe right to
outer publio lauds, subject to tbe
provisions of this act, lying contigu
ous to his former entiy, which shall
not, togetbei with tbe original eutry,
exoeel 320 aores, end residence upon
and cultivation of tbe original eutry

try. Section 4. That at the time of mi k

of a qualified entrymau to make
homestead entry in tbe states named

provisions of section 289 of the re
vieed statutes, but uo person who bas
made entry under this act shall be
entitled to make iiomeetad eutry un
der the provisions of said section,

shall be commuted "under tbe pro
visions f section 2301 of the revised
statutes uutil after the expiration of

upon making proof of residence and
