U.S. Dist Judge John F. Kil lenny, in a 14-page opinion filed Tuesday, ruled on a suit brought by 20 growers in The Dalles who claimed fluorides were hurting their crops. Judge Kilkenny said the pres ent control system is only 90 per cent effective and that if it is not improved he will issue an injunction. He called for the installation of proper hoods around the company's vertical stud soder bcrg cells and electrostatic pre cipitators "in usual, advantag eous and proper places in the plant." The control system could cost up to $2 million, according to the brief. Kilkenny noted that the record shows approximate ly 1.300 pounds of fluorides en ter the atmosphere each day from the reduction plant. He did not attempt to assess monetary damages to growers in his opinion, but said the re quired improvements should en tirely eliminate the problem.
