Everyone, in cluding us, felt Jerry and I were made for each other. Now, after only a year of marriage, we're expert at making each other miserable. I thought he ad mired me, but all I hear now is how clever other wives are. We argue over money, over my rel atives, over his pinochle games. What chance have we? Jerome M. For two years before our marriage, Clarice was polite, considerate and com forting. Now the kid gloves are off and the boxing gloves are on. Hardly a day goes by that she doesn't prophesy I'll never get anywhere. And if I take the wrong lane on a highway, or make a bad buy, her "I-told-you-so" goes on for days. The Council: Remember Di ogenes who spent his days searching for an honest man? Well, we heard a man report that he had an equally hard time finding a happily married couple. He and his wife wanted to charter a yacht and invite a pleasant pair along. "Believe it or not," he said, "we went through our address book and couldn't find any of our friends who wouldn't be sniping at each other most of the time!" So, let's reassure the M's. Marriage is hard. A happy marriage is a tremendous achievement, as dif ferentiated from an endured one. Since there was real love at the start of yours, the problem now is one of more giving i. e., giving in, giving up, and forgiving ... A reader sent me a list entitled: "101 Ways to Wreck a Marriage." Fortunately you've only dipped into a handful of them. How about concentrating on a new list, jointly drawn, of 101 ways to strengthen a marriage? Here is a start, as Ogden Nash puts it in "Everyone But Thee and Me": as forwarded by a Florida reader "To keep your marriage brimming, With love in the loving cup. When ever youre wrong, admit it; Whenever you're right, shut up." Per sons having a legal problem should consult an attorney. ILLEGAL STOCK ASSESSMENTS Harry owned a large amount of the common stock of the Big Bonanza Mining Company. The stock certificates stated that the shares evidenced by the certifi cates were fully paid and non assessable. The articles of in corporation and the bylaws of the corporation also indicated that the stock was non-assessable. At a stockholders' meeting of the Big Bonanza Mining Com pany a resolution was passed authorizing the assessment of one cent per share from all stockholders. Notice was sent to all stockholders informing them that if they did not pay the as sessment their stock would be sold. Harry paid the assessment on his large block of shares and then sued the company to get the money back. Harry did not recover. AY though the assessment was 11 legal Harry had paid it volun tarily knowing all of the facts. If Harry could have shown the payment was not voluntary be cause of some fraud or misrep resentation, of that he had been coerced or forced into paying, he might have recovered his money. The fact that the com pany had threatened to sell his slock to pay the assessment, which it could not legally do, was not sufficient coercion to make his payment involuntary. The person who makes a volun tary payment because he is mis taken regarding his legal rights generally cannot get it back. GOOD OLD DAYS?
