Wayne Morse (D-Ore.) said Tuesday West German misgivings over the nuclear test ban treaty were unwarranted. Morse said West German fears that the pact might mean recognition of Comma nist East Germany were "more a rationalization than real reason." Judge John Kilkenny, who heard the case without a jury, gave the growers and Harvey 12 days to file briefs and re buttal arguments. The judge will consider whether the fumes are caus ing damage and will weigh economic importance of the plant with the economic value of the fruit industry. He also will consider whether grow ers would have an adequate remedy in payment of dam ages by the aluminum firm. The official news agency Antara reported Monday that the animal - too heavy for 10 men to lift - died of in ternal injuries from a tennis bail lodged in its stomach.
