Gov. Mark Hatfield was surk outvoted last year by Secretary of State Howell Appling Jr. and State Treasurer Howard Belton when the board authorized use of convict labor to build the unit. Organized labor brought suit to halt the work, but the case was thrown out of court by a three-judge panel. The judges ruled labor did not have the legal right to sue the state. When asked by United Press International if he had changed his views because of the state's tight money situa tion, Hatfield said "there has been no change in my basic philosophy." Hatfield said he voted against the use of prison labor - because "I felt I had an obli gation to our law abiding cit izens to create Jobs." "I felt this took precedence over my obligations to the convicts," he said. Appling held firm to his view. "I think inmates should be used productively as fully as possible, so long as it is for the direct benefit of ihe state, not for sale on the open mar ket," he said. "The program of providing productive and rehabilitative employment for Oregon peni tentiary Inmates is proceed ing undeterred." The state's Institutions now operate a furniture shop, mat tress factory, tailor shop, laundry, auto repair shop, print shop, sign shop, do maintenance work, cooking, and manage a complete farm program whi:h produces beef. milk, hogs, eggs, and other crops used to feed wards of the state. Appling has long believed prisoners should be used on projects such as making signs for the State Highway depart ment. He said the Kennedy ad ministration has specifically approved the use of prison made signs on federally-sponsored highways. Appling docs not believe prison labor poses any throat to free labor. A bill to restrict use of prison labor is now being con sidered by the Senate Public Buildings and Institutions committee. The measure was introduced by Sen. Ed Fad- eley (D-Eugene) at the re quest of the AFL-CIO. The bill was sent to the committee Feb. 20. No action on it has been taken. Appling pointed out that state law requires use of prison labor as a rehabilita tion measure, and that the Board of Control has operated the institutions with that thought in mind for decades.
