THE PEOPLE OF THE CITY OF CENTRAL POINT DO ORDAIN AS FOLLOWS: Section i: WHEREAS, the City Council did heretofore by ordi nance declare iti intention to im prove Fifth Street from Cedar street to narei aureei in tne city of Central Point, Oregon by the construction of curbs on both sides and the paving thereof and to asset the cost thereof upon each lot or part thereof adjacent to and benefited by such improve ment its proportionate share of the cost of said improvement, and did fix the time and place for hearing protests against aid im provement and the assessment of the costs thereof, as aforesaid, and WHEREAS, said ordinance was dulv Doited and oublished as re quired by the Charter of the City, and whereas, a meeting 01 me Council was held at the time and place fixed in said ordinance for the purpose of considering any such protests, but no protests were at such time, or at any time, made to, or received by the Council to the improvement or the assessing of the cost thereof, as aforesaid, and said Council considered the matter and deemed that said im provement would be of matetial benefit to said City, and that all the orooertv to be assessed there for would be benefited thereby to the extent of the probable amount of the respective assess ments to be levied against said property and did order the im provement, and WHEREAS, the cost of said im provement has been and hereby is determined to be the sum of $39,154.08. NOW. THEREFORE, it is hereby determined that the proportionate share oi tne cost or xne improve ment on each parcel of property adjacent to said improvement and benefited inercoy is ine amoum t finnonit the deacriDtion of each piece or parcel of land below, and that each piece or parcel of land is benefited by said improvement to the full extent of the amount so set opposite such piece or par cel and that the respective amounts represent the proportional benefits of said improvements to aid respective parcels oi property, nd th Council does hereby de clare each of the parcels of prop erty described below is assessed the amount set opposite each re spective description for the cost of said improvement.
