Monroe, Va. -HTl'- Gen. Herbert C. Powell, Oregon bocn commander of the U.S. Continental Army Command, retired from (lie Army Thurs day in ceremonies at this coastal military post. A 17-gun artillery salute boomed a military farewell as Powell and his wife rode in a horse-drawn carriage from the headquarters of the Army's largest training command to the post's main gate. The fife and drum corps of the 1st battle group, 3rd in fantry, Ft. Myer, Va., dressed in Revolutionary war cos tume, beat a final tattoo for Powell, retiring after 43 years service. Powell, a native of Mon mouth, Ore., said he and his wife would spend some time at the Georgia resort of Jekyll Island on "our first real vaca tion in 15 years." Powell, at 16, enlisted as a private in the Oregon Nation al Guard in 1919. Arrested on Warrant-Robert Pankcy, 33, of Phoenix, was arrested yesterday after noon by state police on a war rant from Hood River county on a charge of uttering a forged instrument. Car Fire - The carburetor of an automobile operated by Mrs. Gordon Schulz of Talent backfired and caught fire shortly after 4 p.m. Thursday in Ashland, firemen reported. The accident occurred adja cent to the U.S. National bank parking lot. C. Wernmark, Central Point, is seeking $10,000 gen eral damages and $1,500 spe cial damages from Dr. Paul T. Ruttcr, osteopathic physi cian. Phoenix, and Dr. Max Flowers, Central Point, of the Medford Osteopathic clinic and the Crater Osteopathic hospital, as a result of an op-c-ation performed Feb. 1, 1961. Wernmark claims in a com plaint filed in Jackson county circuit court that an unneces sary operation was performed on his abdomen, the incisions were improperly repaired and he failed to receive proper nursing care. Wernmark said in his com plaint it has been necessary to have a second operation as a result of the first operation, that he has experienced con siderable pain and suffering and expects further medical expenses besides being unable to carry on his normal business.
