YOUR CAR and (he VvS Edi'er's note: Following If the 10th in a series of 12 articles dealing with Oregon motor vehicle laws. Quostions regarding stale motor vehicle laws may be submitted to the Department of Motor Vehi cles, Traffic Safely Division, Salem. Oregon was one of the first states in the nation to pass a law providing for the arimissl . bilily of chemical test cvi- , dencc in cases involving driving while intoxicated. The law was enacted in the early 1 HMO's. -' The law now in effect in 2 Oregon provides that a per son arrested and charged with facie evidence that the de fendant was not under the influence; over .05 per cent, but less than .15 per cent, is considered relevant evidence, but cannot be given prima facie effect in indicating whether or not the defendant was under the influence. If, however, analysis shows that there was .15 per cent Or niftrfi nlrnhnl in Mir, I this is considered prima facie evidence that the defendant was under the influence. To understand these fig. urcs, it is necessary to explain briefly what happens when alcohol cnlers the stomach in tile form of a beverage. Sci entists say It Is absorbed being under the influence of intoxicating lkuor may, upon through the walls of the slum his consent, be given a chem- ch and the small lnlcsline v leal test lo determine the : amount of alcohol in the per- son's blood. The lest may he of the blond, breath, urine or other bodily substance, but if a blood test is to be given only a duly licensed physician, or a person acting for the physi cian, may withdraw the blood. Several key words affect administration of the law. In the first place, the person must be arrested and charge! wMh 'the jpecific offense 1 driving under the influence; he cannot be asked to take a chemical test in connection Willi any other violation. Sec ondly, lie must give his con sent lo the lest. The consent may be verbal or written. Un til mtil, consent had to be in writing. Refusal Not Admiiiable Should the person rcfu.ve to take a chemical test, none call be taken. Further, the rc , fusal to permit a lest is not admissible in evidence against him at his trial. The law in Oregon, and ntot other ,st;ites that 115 per cent Into the blood stream. The blood carries It lo all parts of the body which contain water. Including the brain. Thus, the degree of intoxica tion and its effect on driving ability can be determined by the per cent of alcohol in the blood, breath, urine or saliva, though (he latter test Is sel dom used. Believed Too Liberal Many scientists believe (he .15 per cent figure is too lib eral. Further experimenta tion, they say, indicates that practically all human beings arc unfit to drive with as much as .1(1 per cent blood alcohol concentration, and thai many are unlit at much lower levels. Chmccial test evidence is not as widely used as satety proponents believe it should be because many people re fuse to permit a chemical test. Chemical lest proponents maintain that greater use of the tests would protect the innocent, as well as aid pros- provides edition of the guilty less al l (Next: When von eel a leaf. cohol in the blood is prima I (ic ticket) "i i i r 'vi. few "J? fcfcs X-, 7j v NEW HEAVY TRUCK He's trucking along with a new heavy gauge steel samlation department truck that's realistic and ai c uiale in every niiniatiiie scab d detail It boasts such extras as white wall tires, windshield wipers and a horn By Slructo Manufacturing company.
