POOR IVAN'S a nn UU TV HOME CALLS Simply Call 772-S822 Oregon Supreme Court Decisions Salem IUPII An award of $32,410 for a Curry county couple in a highway condem nation case was reversed by the Oregon Supreme court Wednesday, ruling there was an error in selecting the jury. Curry County Circuit Judge Robert C. Belloni was re versed and the case was sent back for further proceedings. The property owners who had been given the award, $28,410 plus $4,000 in attor ney fees, were James Robert Walker and Alice M. Walker. The Oregon Highway com mission successfully appealed. Justice George R o s s m a n wrote the decision. Rossman said it was an error to deny the nignway commission attorney a third peremptory challenge as the jury was being chosen. Challanga Refutad Both sides exercised two peremptory challenges, and the commission attorney said he was satisfied. But then the Walker's attorney exercised his third and last challenge. When the commission attor ney sought his third chal lenge, Judge Belloni refused to allow it. This was a mistake, Ross man said, ruling that a chal lenge although waived can later be exercised upon a juror called to the box after the waiver.
