MEDFORD, OREGON Salpm (DPD - Oregon HiRh- way Engineer Forrest Cooper Tuesday strongly denied a na tionally televised report Mon day night that indicated the Oregon Highway Department may have engaged in im proper right of way acquisi tion practices. He referred to "David lirinkley's Journal" on NBC TV. Oregon was listed along with a number of other states a having nupHtionable admin istrative practices in connec tion with the spending 01 ieu eral highway funds. Said Unfounded In a two-page statement, Cooper said Brinkley's state ments were "unfortunate" and unfounded. "The right of way activities in this state have been conducted in a manner that is strictly within the pub lic interest," Cooper said. "It would appear that Mr. Brinkley's information was obtained from a General Ac counting Office's report that was the result of an audit made in Oregon several years ago." Cooper said. "The audit," Cooper went on, "purported to cover the period of July 1, 1056, to Sept. .10, 1030, and covered over 4,000 separate right of way acquisitions. Of this number, only three Items caused com ment. At no time did the Gen eral Accounting Office infer that improper practices ex isted in Oregon." Cooper said Oregon was criticized in one instance where one of the terms of a right of way settlement al lowed a nursing home five months in which to relocate after the settlement was made. Not Unreasonable "The Institution In question was a concern in Southern Oregon with a 60-patient ca pacity," Cooper said. "Ap proximately 75 per cent of the patients were county wel fare patients. The department feels that the five months res toration time was not unreas onable. It did not delay the highway construction, and had any lesser time been demand ed, it could have worked an acute hardship on the persons involved." "The only other cases cited had to do with matters of opinion or Judgment and in no way reflected on the propriety of the transactions." But if they fail, it won't be for lack of trying. Vigorous Battle The Brown-Nixon campaign is by far the longest, loudest and most vigorous battle in California politics in the last 20 years. From dawn until nearly midnight, seven days a week, the 49-year-old former Repub lican vice president who nar rowly lost the presidency in 1960 and the man he seeks to unseat, 57-year-old Democrat Brown, range the state from Tulelake on the Oregon border to San Diego near the Mexican line. Moth men are keying their campaign to a "person to per son" pilch. A typical daily schedule goes like this: Morning News conference In Los Angeles (where 40 per cent of the state's vote is con centrated); walkathon tours of shopping centers, office build ings and factories; fly to San Francisco. Afternoon More walka thons and street rallies in the predominantly Negro Fill more district and the Italian North Beach area. Evening Fly to Stockton for a rally; fly to Salinas for a telethon and radiothon. Brown Better Known While Nixon is belter known nationally after eight years as vice president and a national campaign in 1960, Brown is belter known per sonally in his home state. Nixon, until he launched his campaign for governor a year ago, had not made a grass roots tour of California since 1950, while Brown has toured every one of the 58 counties in two successful campaigns for attorney general and his win ning battle against U.S. Sen. William F. Knowland for the governorship in 1058. On the many issues In the campaign, they are poles apart. Brown insists California's business climate has never been belter. He says unem ployment is down, personal in come is at an all-time high. the budget is balanced, the slate's crime rate is low and "things never have been bel ter."
