Gladden said today the law which requires an ap peal to the State Supreme Court of every death sentence in Oregon is a good one. Under the 1955 state law, all con demned per sons get an automatic ap pear to the high court wheth er they want it or not. This, Gladden said In an interview, provides a com plete and final judicial deter mination as to whether a capital offender should be executed. One of the sponsors of tile 1955 law was Stale Sen. Mark Hatfield (R-Salem), now the governor. Throe aulnmatic appeals are in the high court now. Sentenced to death and in Gladdcn's custody are con victed slayers Lee Roy San ford McGahucy, 44; Jeannace June Freeman, 20, and Larry West Shipley, 20. McGahuey and Miss Free man were accused of killing children and Shipley shot a teen-age girl, all last year. If any of them die in the Oregon gas chamber, it will be the first execution here since 1953, and the 58th since the state took executions away from the counties in 1903. The complaint in 1903 was that county executions were drawing large crowds. Gladden, a tall man with gray steel-colored hair and a voice like churning gravel, has stated various times upb licly that he personally op poses capital punishment. But he revealed that until about 12 years ago, he was a strong advocate of the death penalty, i While in more than 35 ! years of penal service he has j never gassed, shot, hung or electrocuted anyone, he at-1 tended the hangings of two I murderers at California's Fol-1 som prison in the 1920s. "People with wealth and influence seem to be able to get delay after de lay and get off with life, rather than pay the supreme penalty." He cited several re cent nationally - publicized cases. Gladden said those without money or power seem to pay with their lives every time and not because they are guiltier than rich offenders. Gladden, who has been the warden here since April, 1953, also feels that one argu- ment for the death penalty is that the natural will to live is at least some deterrent to potential capital offenders The last person lo be executed in Oregon was Al hcrt W. Karnes, 24, who killed a Salem woman dur ing a robbery. Hp was execut ed on Jan. 30, 1953. Sixteen others preceded him in the gas chamber here and before that Oregon had 40 hangings. In 1957 Gov. Robert D. Holmes saved wife slayer George Sack, Portland, and James Norman Jensen, Med ford hatchet slayer, from the gas chamber by commuting their death sentences to life. Holmes gave three reprieves in 1958 to Billy Junior Nunn Klamath Falls child slayer, and in 1959 commuted Nunn's sentence to life. Gov. Hatfield hasn't yet had to face the burden of whether to grant a reprieve or commute. McGahuy s appeal was heard by the high court April 9, and the Freeman and Ship ley appeals are expected to be heard by July. If the court upholds any or all of the death sentences, one or more execution dates could be set before the year is out.
