Finally a committee of Upper classmen confront ed him and demanded, "Frost, just what do you do walking by yourself all the time in the woods?" By Jimmy Hatlo Jury Continues Los Angeles -IUPD- The third murder trial of Dr. R. Bernard Finch and Carole Tregoff re sumed today after a one-day recess caused by the illness of the surgeon's new attorney. Maxwell E. Keith, who re placed Grant Cooper as Finch's counsel, telephoned Thursday to say he had the flu and could not attend. He was required to obtain an affidavit from his doctor that he was ill. Presiding Judge David Cole man released prospective jur ors until today because of the illness. Selection of a jury is expected to take at least a week. Finch, 43, and Miss Tregoff, 24, are charged with killing his wife, Barbara Jean, July 18, 1059. The first two trials ended with hung juries. The rate 120 adult prison ers for every 100,000 of the general civilian population says James V. Bennett, direct or of the Federal Bureau of Prisons "cannot be matched anywhere else in the world. It is a record we cannot be proud of. We must do all we can to get rid of it." The statement, part of a discussion of prison and ju dicial controversies, appears in the January issue of "Crime and Delinquency," quarterly journal of the National Coun cil on Crime and Delinquency. One thing the courts can do to help solve the problem of overcrowded penitentiaries, says Bennett, is to refrain from using prison commit ment when it isn't necessary. "However you view it," he added, "prison is lough med icine and appropriate only for those who require tough med icine. Major surgery ought not to be used to clear up a pim ple; major surgery, where a shot of penicillin would do, may be disastrous for the pa tient. The same principle ap plies in dealing with the of fender." Another thing that judges ought to keep in mind, writes Bennett, is the limitation of the institution to which they send an offender. Of the 35 Insti tutions in the federal prison system, only seven have psy chiatrists on their staffs. "In a recent survey," he says, "we found that there are only 32 full-time psychiatrists employed in all the stale in stitutions for adult offenders. Fifteen of the 32 psychiatrists are accounted for by Cali fornia; the other 17 arc spread out in institutions in 11 slates; 38 states do not have even one full-time psychiatrist employ ed in their institutions for adult offenders. Even if a prison is fortunate enough to have a psychiatrist, the num ber of prisoners he has time to treat is severely limited. He is lucky if he has time enough to perform the diag nostic services that are re quired of him." A third condition that must be corrected, says Bennett, is the great disparity in sent ences for the same offense. "Even for murder, the time served by those who are re leased varies from five years and four months in Virginia to fifteen years and two months in Ohio." For man slaughter the range is "from 17 months in Tennessee to 54 months in New York. The average time served for rob bery is one year and three months in Colorado, but six years in Indiana."
