S 8 COURT HELD stun o public service by lh COLLEGE of LAW WILLAMETTE UNIVERSITY 'Gift' Interpreted ai Inheritance 'Advancement' Charles gave one of his sons, Junior, $25,000 to help him start a business. Soon thereafter Charles died, leav ing his sons, Junior and Sonny, as his only heirs. Charles did not have a will. His net estate totalled $75,000. In the scramble for their father's estate, Junior and Sonny disagreed as to wheth er or not the $25,000 gift to Junior should reduce his share, so they wen I to cou,rt. THE COURT HELD: Junior gets $25,000 and Sonny gets $50,000. It is presumed that when a parent makes a sub stantial gift of money or property to his child during his lifetime such a gift is an "advancement" on the child's Inheritance. This presumption is particularly strong if the money or property is to be used for business rather than pleasure. Of course, this pre sumption can be overcome by evidence indicating that the parent intended an outright gift with no "advancement" overtones. This presumption is sometimes changed "by statute. It does not apply if the parent leaves a will. This column of general le gal principles is presented by the Willamette University ' College of Law. Scout News Roundtable Scheduled "Genius Night" will be the theme .discussed at the Big Pines District Cub Scouters roundtable along with the an nual "Blue and Gold" banquet and traditional window dis play during Boy Scout Week in. A model Cub Scout window display will be set up at the roundtable byPack 41 of Grif fin Creek to give all new packs and parents an idea of what will be expected of them and some suggestions to use for their display.
