Although she was not a mem ber of the church, she attend ed in response to publicity circulated to attract a crowd. The game was conducted sole ly for the purpose of making money for use in the church's various activities. Unfortunately, the chair in which Mabel sat while playing was not in good repair. It col lapsed and she was injured. She brought an action against the church to obtain damages for her injuries. The church defended on the basis of "charitable immunity," a doc trine which provides an im munity to charitable institu tions regarding any tortious act committed by their agents. This exists as an effort to pro tect trust funds of charitable institutions. THE COURT HELD: The supreme court of an eastern state, in this 1960 case, how ever, held that the church was liable. It reasoned that im munity from liability depend ed upon whether or not the church was engaged in the charitable purposes for which it was founded at the time the injury occurred. In this case, the court held that the church was conducting a "game of chance" as a business enter prise; therefore, it was liable and must respond in damages. Mrs. Bert L. Chaffin had been listed on the serious list since the accident occurred early Saturday morning on icy and fog-shrouded highway 30 six miles north of Ontario. Killed in the accident were Mrs. Cliaffin's two children, Bert, 8, and Edith, 6-months. (UPI Telephoto) BLM Starts Program To Streamline Land Use and Management Washington - (CQ) - A $4.1 billion 52 -year program to streamline the management and use of nearly 500 million acres of public lands has been launched by the Bureau of Land Management, the princi pal custodian of the public do main. But it's headed for trouble in Congress. The program is called Proj ect 2012 and its aim is the sympathetic, balanced and co ordinated development of the nation s public lands and re sources, including minerals, timber, forage, wildlife, water and recreation. The target date for completing the pro gram is the year 2012. Project 2012 is primarily a conservation program and as such helps fulfill one of the principal responsibilities of the Interior Department, the Bureau s parent agency. Con- servation, and the related tasks of management and de velopment of natural re sources, is not the assigned job of any one office in the Department. Instead, it is the responsibility of each of its major operational offices in the areas which they manage. These offices carry on a co ordinated effort to maintain maximum conservation of the nation's natural resources. Two Major Obstacles Two major obstacles may prevent completion of Project 2012: Congressional appropri ation of funds amounting to more than three times the cur rent annual appropriation, and passage of certain key legisla tion which the 86th Congress rejected. If the $4.1 billion which the Bureau expects to spend on Project 2012 is distributed evenly over the 82 years, it would require an annual ap propriation 0 1 $78,846,154. The Bureau's appropriation for fiscal 1961 was $26.3 mil lion. The legislation which the Congress turned down this year would have permitted the Bureau lo sell certain of its lands for urban, suburban and business uses. Under the proposal, which BLM said was necessary to carry out the program, the Bureau would have sold the land to brokers who then would have sub divided it for sale to Indi viduals. C o n g r ess, fearing speculation by the middlemen, rejected this suggestion and made no attempt to pass a satisfactory substitute. Sen. James E. Murray (D- Mont.), chairman of the Sen ate Interior and Insular Af fairs committee which has jurisdiction over most of the legislation relating lo the pro gram, wrote Secretary of the Interior Fred A. Scaton that his proposal was "late, but welcome" despite the fact that it lacked data on investment and operating costs and a state by-statc analysis for both short- and long-term periods. Murray said this Information was necessary In order to ana lyze the program. The In terior Department said it will supply this information. BLM is charged with man aging about 477 million acres of approximately 800 million acres of federally owned land. In addition, it surveys all fed eral lands, manages publicly owned mineral resources on private land and carries on numerous joint management activities with other federal agencies. The program would be of special interest to Alaska where nearly 300 million acres of the Bureau's 477 mil lion acres are located.
