After pulling the animal out the boys rubbed it down with dry rags, then wrapped it in blankets. Hooves of the deer were so worn the woods creature was hardly able to stand, a troop committeeman reported. Apparent 1 y the hooves were worn down as the deer attempted to climb up the slick ditch sides in an air tempt to get out, he observed. Final Arguments Due Monday in $40,000 Lawsuit Final arguments will be presented Monday in Jackson county circuit court in a dam age suit involving an accident on a farm owned by John Bil lings, just north of Ashland. Benjamin Christ 1 1 e b. 355 Otis St., Ashland, is seeking $40,000 in one cause from Billings on charges that he was reckless and wanton, and $24,000 on another cause for "simple negligence." The suit is the outgrowth of an accident which occurred on Oct. 12, 1958 on Billings' farm. Christleib and a com panion, Richard M c Kinnis, also of Ashland, had gone onto Billings' land to retrieve a pheasant which they had shot, according to evidence presented. Struck By Car While the two hunters were walking t o ward Christlieb's fence line, Christlicb was struck by Billings' car and was injured, it was alleged. Chrisllieb claims he received a broken rib, cuts, suffered shock, and aggravated numer ous old injuries. He also claims that the accident was "wanton and with implied disregard for social obligations." Billings, in his defense claims that Christlieb was "a trespasser," that the accident was "unavoidable," and "that Christlicb stepped in front of his vehicle."
