OCTOBER 21. 1960 Sign Agreement roved The Medford last night approved an agree- ment permitting billboards on City .property near the air port, providing that the bill board company give the city nee sign ana pay back rent. The agreement pnvp fnnr , billboards that have been lo cated along Crater Lake high way for the past' few years Directors To Be Medford Chamber of Com merce President Gerald T. Latham appointed . four men . Thursday to serve on the chamber's nominating com ,. mittee. The committee will nominate persons to sit on the ( chamber's board of directors. Appointed to the commit , tee are Frank Bash, Otto Ewaldson,- Ken Cook and Dwight Houghton. The ap pointments were made at yes t terday's board meeting. Chamber Manager Don Mc Neil said the committee will suggest 16 names to fill the eight positions that will ex pire at the end of this year. , One-third of the 24 members i of the board are retired each . year. A board member is not , eligible to serve a second . three-year term until he has been, off the board a year. The eight members who will be vacating seats are Bash, Cook, Ewaldson, Hough ton,, Latham, H. D. Christen sen, Chet Hubbard and C. H. Young. The final selection from' among the 16 nominees will be made by the chamber membership. '. McNeil said the chamber makes an effort to have a : cross-section of business cate gories represented on the board.' However, McNeil aid, no member is selected for the board unless he . has expressed an .interest to do ' so, and so it is not always : possible to get the desired ' cross-section. . ' 'Second Annual' Train Move Set Medford's parks and recrea tion department will celebrate Halloween this year with the "second annual" move of the Medco logging engine at Jack son park. - Parks uirector Kooert ia worth made the announce ment at last night's parks and Mnrnnti nn nnmmtceinn m Apf. ing: He said the move will come one year "to the day" after the engine was original ly moved into the Jackson park site. The old logging engine has historical significance and was donated to the city by the Medford corporation last year. It became the center of a recent controversy when resi dents, along McAndrews rd., ' complained to the city mat 4ha Antrim. hlnplcpH their view and called it a "monstrosity." Haworth said the city has decided to. move the engine to a permanent location on Clark st. He added that vol- unteers to help move tne en ' gine are more than welcome. Under the agreement as originally proposed to the council, Foster and : Kleiser company would simply turn one of its signs over to the city and then furnish adver tising and maintenance of the sign in return for rent both past and future. , , Amendment Suggested C o u n c i 1 m a n R. L. Van Sickle moved to amend the agreement by stipulating that the company pay the city $345 in back rent accumulated over the past couple of years at the rate of $25 annual rent per sign. . ' , . City Manager Robert Duff agreed that it was worth a try but said he was "not sure" the company would accept the amended agreement. Councilman Robert Baccus voted against both the amendment- and the main motion saying: "I am against bill boards in general. I don't think they add anything to aesthetic values.'.' ; Agreement Approved for Radio Transmi tter o n RoxyAnn B u tte Approval was given by the Medford city council last night to an agreement be tween the city and the county for location of radio transmit ting and receiving facilities on Roxy Ann butte. Under the agreement the county would not be able to construct any facilities on the site without the prior appro val of the city manager. The agreement is for 10 years and requires that agen cy radio operations be con ducted so as to cause no in terference with other agencies authorized use of the Butte, according to a report prepar ed for the council by City Manager Robert Duff. The report, said: "It has been concluded that there would be no adverse effect on the scenic or recreational val ues of the park by allowing such radio use." - Agencies to use the site in clude the Oregon state high way , department, Oregon state police, Rogue River Na tional forest and Jackson county. , : Approves Projects In other action last night, the council approved two im provement projects after no one spoke at public hearings on each of the projects. One of the projects con cerns construction of a water main on Beatty st. from Mc Andrews rd. to Manzanita St., and on Manzanita St. from North Beatty st. to South Beatty st. One resident of this area had several questions re garding this project and they were referred to the water department. The other approved project provides Jor construction of a sanitary sewer in the Crest view subdivision. The council awarded the sale of $503,21-6 in Bancroft bonds to the U.S. National Bank of Portland, which sub mitted an apparent low inter est bid of 3.23006 per cent. The First National Bank of Oregon also bid on the bonds. The bonds are from various improvement projects, includ ing paving, water mains and sanitary sewers. Hearings Scheduled ' Four public hearings were called for the council's Nov. 3 meeting. One is, for con struction of a 6-inch water 3 Council Asked To Summon Cab Firm To Answer Charge Medford Lawyer Ben Day asked the Medford city coun cil last night to summon Carl Kellenberger, owner of the Yellow Cab company, before it to show cause why his li censes to operate both a taxi cab company and limousine service should not be re voked. Day, representing the Med ford Airport Limousine serv ice, said he was making the request on the grounds that Kellenberger has violated several provisions of the city code relating to the operation of both taxis and limousines. Day presented a copy of a sworn affidavit to the coun cilmen which he said attested to the alleged violations. Action Deferred The council asked to take action for the first time in its remembered history chose to defer action on the request pending a more thorough study of the matter. - - The request brought into focus again the problems con cerning Medford's two taxi- main on Prune st., Park Place No. 5, and Alberts st. The other three hearings are oh planning commission recommendations. One is for a change of zone from single family to multiple family at 2120 Table Rock rd. Another is for a change of zone from Class IB to heavy industrial for several lots in . the Oak Park addition. Councilman Donald Hanson asked the city manger to prepare a brief re port on this latter requesti The fourth hearing con cerns a planning commission proposal to change the name of a section of Crestbrook rd. between Ellehdale ave. and Highland dr. to Greenwood St.' - Action Deferred A planning commission rec ommendation, for a variance to setback requirements to al low construction of a patio cover along a property line at 509 West 11th st. was de ferred by the council at the request of Hanson. Hanson said he is not sure how this request differs from similar ones that have been previous ly denied by the commission and council. Councilman Stanley Stark voted against the deferral. A request to conduct a saw filing shop as a home occupa tion at 1002 Murray st. was approved by the council. It had previously received the favorable recommendation of the planning commission. Contract Awarded The council awarded a con tract, to provide the city with fuel oil during the period Nov. 1, 1960, to Oct. 31, 1961, to L. G. McLaren and com pany. They had submitted the low bid of three bidders. Jacksonville Holds Achievement Night Jacksonville 4-H clubs held their first annual achievement program recently at the Jack sonville Community hall, ac cording to County 4-H Agent Glenn Klein. Bob Hein, of the Medford branch of the First National Bank of Oregon, presented pins and cards to the 4-H club members according to the years of club work com pleted. A special record book med al was presented to Pamela Dunlap for her outstanding record in the Meal Time Fun division of the Jacksonville county fair board's record book contest. President Russell Fields presided over the meeting and the banquet that was served by the cooking club girls. Those who received pins were, four , years, Patrick Neal; two years, R u s s e 1 1 Fields and Kathleen Neal; one year, Marcia Dunlap, Pamela Dunlap, Patricia Glathar, Robert Glathar, Leslie John son, Charles Logan, Donna Smith and Richard Wilson. Nixon Hairpiece Denied by Aide New York - (UPD - Herbert G. Klein, Vice President Rich-1 ard Nixon's press secretary,! denied Thursday night reports I that the Republican presiden- tial nominee is wearing a hair-1 piece. i "I've heard all kinds of I charges in this campaign, but this is the silliest," Klein said. I "It's obviously and definitely false." O I CHILDREN'S AUTHOR DIES Katonah, N.Y. -IUPII- Mrs. Harriet Hughes Dallas, 82, children's author and widow of C. D. Dallas, former board chairman of Revere Copper and Brass Co., died Thursday. cab companies and two limou sine services that have been plagueing the council for the past year. . These problems started last November when applications were 'filed, with the council for licenses to operate an ad ditional taxi-cab company (Courtesy Cab) and a limou sine service (Medford Air port Limousine service) ' in the- city. Prior to that time the : Yellow Cab company was the only operator of that kind in the city. Day and his clients cited four basic instances in which they allege Kellenberger is in violation of the city charter. They are: Not Meeting Flights "He (Kellenberger) is not attempting to meet all sched uled airline: flights for the public convenience, ' but in stead is using the Yellow Cab limousine for other purposes. "That the Yellow Cab Airport limousine is used as a taxi-cab without a taxi-cab license. . Two funds, the Stevens Street Water Main Fund No. 2, and the Wabash Avenue Water Main Fund No. 1, were created by council action. , . Two projects, a water main on Stevens St., and a sanitary sewer on Niantic St., were ac cepted by the council. Action on a petition seek ing paving, curbing and gut tering of Benson st. from Prune to 10th sts. was de ferred by the council as the petition, according to the city attorney, did not bear the necessary number of signa tures representing more than 50 per cent of the assessable front footage. , ' .... i Sale Deferred . A proposed sale . of city property along Benson st. to Keith B. Lawton for $100"was deferred by the council. The council awarded a con tract to M. C- Lininger and Sons to construct a 6-inch wa ter main on McAndrews rd. from Waverly ave. to Wabash ave., and on - several other streets in the area. Lininger and Sons submitted an appar ent low bid of $15,305. Plans and. specifications for the installation of a sanitary sewer in an alley between Park Place No. 5 and Alberts st., to extend from Dakota to Prune sts., were approved. SONOTONE MEDFORD MAIL TRIBUNE. MEDFORD, ORE. "Yellow Cab taxi-cabs are regularly charging limou sine fares for trips to and from the airport. "Yellow Cab taxi-cabs are sent to answer limousine calls and" hold themselves out to passengers as being part of the limousine service, although they are not li censed as limousines." Aware of Requirements Day's request also contends that Kellinberger is well aware of the requirements to be followed under the city charter regarding the opera tion of taxi-cabs and limou sines. The notarized affidavit, signed by Clarence Jones, co owner of the Medford Air port Limousine service, cited specific instances of the al leged violations. One of these supposed spe cific instances says: "The failure of the Yellow Cab Air port Limousine to meet (com mercial airline) flights (at the airport) was often due to the fact that the limousine was being used to haul Mexican Nationals to and from the city of Medford and the Mexican Nationals' camp." Under a provision of the city code adopted several months ago by the council for the specific regulation of limousine: "Operators serv ing the Medford Municipal airport with limousine serv ice shall provide adequate limousine service to the pub lic for all scheduled air line flights." Cites Over 20 Cases The affidavit cites more than 20 cases where it says the : Yellow Cab limousine did not meet regularly sched uled flights. City Attorney Joel Reeder last night said th procedure being requested by Day and the Medford Airport Limou sine service is a correct one. Reeder said there are two such remedies in the code- to provide for the handling of alleged violations. One is the procedure being requested by Day for a "show-cause" hear ing and the other is a pen alty of $100 and 50 days in jail -upon conviction. Councilman Donald Hanson seemed to sum up the sent! ments of most of the council men when he said, "if we do (call for-a "show-cause' hearing) it will be the first. time the council has done this sort of thing . : . " He moved that the council consider the matter as a committee of the whole and the council un animously agreed with this motion. attract health workers from Jackson, Josephine, Lake, Klamath, .
